Spouse married to Citizen residing abroad

Hello all,

I am Canadian PR holder since August 2018. I am currently residing in US with my Canadian wife. She is working for a Canadian company in US. My question is that, the days I live outside of Canada with my wife, can they be counted towards Citizenship?

No. You must be physically inside Canada for any days to count towards citizenship qualification. However your time with your Canadian wife outside Canada does count towards PR Resident Obligation.

Can I stay in Niagara Canada and work in Buffalo, USA. I will be traveling to US in morning and will return back to Canada same day evening. Will that day count as physically present in Canada? If so, will there be any difficulty when filing for Citizenship?

Yes, you can do this. However you could be at risk of getting RQ since you will have tons of travel records that you have to show. You basically have to list every single exit / entry to us and Canada. That will be a long application for you to complete.

And make sure you keep good travel records, especially if you have a status that doesn't allow for I-94 reporting. Getting the entry records from CBP and CBSA may be helpful, but they are notoriously inaccurate at times.

This type of application will be scrutinized by IRCC since it is looks like the only reason you have a residence in Canada is to get a citizenship (you work in the US and your wife lives and works in the US and you only come back to Canada strictly for RO purposes). Your ties to Canada are weak. But as long as the rest of your application is solid, you should technically qualify.

Thank you for the respond. Can you please explain what do you mean by " Rest of application solid"? I thought main qulification for citizen is to live in Canada for 1095 days in 5 years.

The OP has Canadian wife so going back to Canada to maintain PR RO is moot since staying in US with wife allow him maintain RO while living in US. I think you meant to say "staying in Canada for citizenship purpose only" not RO..
