Possible to waive medical exam for non-accompanying dependent?

Hello guys, I have the same situation... I am about to submit my paper based PR application and I can't provide a photo of my non accompanying dependant because my ex refused to cooperate, and I know that when CIC request for my dependant's medical, I won't be able to provide it as well.. My question is can I submit an LOE and statutory declaration on my initial application that I am excluding my child since I tried everything to convince my ex girlfriend to have my child's photo and medical but wasn't successful?

I have submitted the LOE along with all the proofs about me contacting my ex for the medical of my dependent child. I have even notarized the LOE. You can also try the same thing. My case is still under process so I cannnot tell you whether this works or not. But other than this we actually dont have any other option.

Did you submitted the LOE and supporting documents in your initial application or did you only submitted it wgen CIC requested the medical?
Another question, what if some of our conversation are not in English? Can I translate it myself? In this case, I am providing screenshots of my conversation with my ex that shows she is refusing to cooperate.
I have submitted LOE when we have to submit all the documents after getting ITA. That is when CIC requested the medical.
regarding your second question. Translate all the material that is not in English from a certified translator and have that notarized. This is required because certified translator also provide affidavit that they have translated all the sentences word by word and sign it. This affidavit is required whenever you are providing any translated document. Submit that affidavit+ english translation of the document+ original document.

I am in similar situation. We have parenting order in place where we both have liberty to take decision on child day to day care when in their respective care. We don’t have used term sole custody though! However I haven’t seen child since he was 3 months, and not even willing to meet or sponsor him. He is in Australia with my ex. I have applied inland. Ex is totally non responsive.
I tried to email him 3 times to the email address listed in our court order as preferred mode of communication and tried to fb msg him , he has checked the message but not responded any of it.
Can I send these emails n fb chat proof to IRCC and send notarized statutory declaration that I m willing to give up the right to sponsor and I tried but he is no responsive. Would it b acceptable and can proceed further with my application?
And where to send these mail , is it to Mississauga case processing centre where we originally sent application?
I am not aware about the place where the details can be sent for paper application as I have applied through Express entry and have to upload documents online.
If you have received any communication try figuring out where the details can be sent.
For the child medical, you must have declared him non accompanying, even then you will have to provide medicals as ircc does not like to exclude children.
My guess on your case is, since you have a court order for child care, ircc will want to provide you more information on your efforts to have him done medicals.
You may take a lawyers help to have your ex-spouse respond to your requests as the custody is not specifically mentioned in your papers.
You can write in detail to ircc about the while situation, explain in with proof of your efforts.

I also received a request for medicals for my 4 children today who are non-accompanying. I sent a notarized letter with my original app stating I wanted to surrender my right to ever sponsor them in the future. I also explained why which is because 2 of them are not allowed to leave the State of $%^%$, USA and also that I haven't had contact with my older two ages 20 and 21 and I don't have a current address for them.
I also sent in a copy of my divorce decree showing where the 2 of the kids were not allowed to leave the state and I had a friend from TX write a letter of explanation of my family situation. (that was recommended my the local MP's office) Still, I received a request for a medical today. I'm going to try to resend in the letters and divorce decree via the online form. I hope that will help.

I wanted to follow up on my case for the ones who were waiting for an update, apologies for not posting before.
After sending the last notarized letter, I got a form from CIC asking me to sign it, in such form, I was excluding my child from my family group thus renouncing to the future possibility of any kind of sponsorship. One month after I sent the form to CIC, I got a letter requesting to send my passport for the issuance of the immigration visa. When my passport came back, it came with the mentioned visa, giving me few months to arrive in Canada.
I did it as quickly as I could, landing by the end of February and I just received my PR card in the mail last Monday!
I hope this thread gives some help to other people in the same situation.

You have to mention your child in the dependants' section. Additional Family information should be filled in with information about YOUR siblings and father/mother.

I’m just wondering if the last CIC form you had to send in, renouncing the possibility of future sponsorship, also had to be notarized? I’m dealing with a form entitled “Declaration With Regard To Non-Accompanying Dependent Who Is Not Examined" from CIC which requires a signature from a witness.

Ok I got a an exclusion for my son whom i have not seen since birth more than 12 years back. He is in a different country. I have since re-married and have kids.
First i didnt include non-accompanying kid in the application. I didn't' but sent a revised application. Also attached a LOE stating why I didnt include + a declaration. Simple worded:

I do have a (****son or daughter) from my first marriage, born (****DOB) but he is NOT my dependent NOR will I be sponsoring him for immigration.
My Ex-Wife has custody of him divorce and they live in a different country (***) and the mother is solely responsible for him.
The divorce was not pleasant - we do not have any communication between each other, etc etc etc.
I have not included him in my application as he is not with me and I am not his sponsor, now or in the future.

I am facing same issue with my spousal application I applied my husband in March 2017, since that all the steps are completed however he had two kids from his previous marriage. His ex is not supporting her to let kids go under medical exam and now we are stuck application processing time is over long time ago. We already submit a letter to explain our situation that we can not provide children medical exams as she is refusing but we do not have written proof as she is sending verbal messages through relatives. My husband already accept and request in the letter that he won’t apply his children in the future. I don’t know immigration are not responding is it has been two months already we sent them this letter. Anybody aware how long they take and what else I should do? What options I have now. I am very worried and disappointed by the situation I am facing .. please help it has almost 2 in half years I am waiting for my husband ..
