Implied status under BOWP

Hi everyone,

I'm seeking advice as I am in a pretty tricky situation right now. Let me explain.

I have submitted my Express Entry profile in April, and I'm now sitting at 437 points. Considering the whole trend of 440 right now, it's reckless to expect an ITA soon (IMO).

I am currently working in Canada on a PGWP in a company where I started in mid-November 2016. The catch is that my work permit expires November 4, so I have very little time.

According to a couple of sources online, CIC counts work experience by month, which means I will have accumulated 24 months of experience in October (at the beginning, I suppose). That will give me a boost of additional 25 points.

Assuming the above is true and CIC keeps running draws every other week like now, I should get the ITA after the October 3 draw. On a side note, I am taking an upfront medical exam to not waste any time later. With that, I apply for PR as soon as possible.

In my understanding, after that the eAOR shouldn't take long to get, so I can use it to apply for a BOWP. From what I heard, it takes up to several months to receive..

So, provided that it all works out, is it possible to get an implied status for that BOWP and continue working at my current job, and if so, how?

nowadays it takes 50+ days to get this BOWP...to apply for it you need to have AoR letter available and your current work permit still valid..once you apply for BOWP and keep on waiting for PR and BOWP you can continue working under implied status with the same SIN and everything..find legalfalcon user here and ask for a legal advise in a special thread if still not sure..good luck!;)

Actually, IRCC defines full time work experience as 30 or more hours per week - meaning, the denominator is weeks, and you need 52 weeks to equal one year. This is how IRCC counts work experience (despite the way the profile only asks for MM/YYYY).

Here's the problem with your plan. To get the BOWP application submitted in time, you would have to submit your eAPR before your current permit expires, meaning, before you actually complete the 2 years . This means that (despite the system awarding points early) you are not eligilble for the points for the 2nd year. Assuming the VO catches this, they would deduct the points from your CRS score; if your new score it falls below the threshold for your draw, you will be ineligible and refused. This determination will not be made until after you pass the completeness review, tho, so it will not affect your eligibility for the BOWP. (unless this determination is actually made before the BOWP is issued).

This may be acceptable to you, as the cost of getting the BOWP, and you don't mind having to re-apply (at that time, you WILL have 2 years).

Keep in mind if your application is rejected as incomplete, your BOWP application will also be rejected. So make sure it is complete : )

There IS always the possibility that the VO makes a mistake and accepts the 2 years of experience. But I wouldn't bank on it.
