Hello Friends,
I've recently submitted my EE profile and received a score of 450. Nevertheless of my chances getting an ITA, I have a concern regarding my chances of getting a PR if I submit my application. I'm currently in USA on a student visa and am recently charged with an offense (misdemeanor) of possession of marijuana (around 2 grams) . The case was DISMISSED and I was proven NOT GUILTY. However, I believe this will still show up in the FBI Report that I was arrested, released the same day, and that the charges were dropped later.

Wanted to ask the members of this thread if they might have any idea about such a charge hampering my eligibility or chances of getting a PR. Any suggestions or advice to deal with these cases would be highly appreciated.

Thanks a lot in advance.

As far as I know they make the decision based on Canada laws, not US. So you need to see if this misdemeanor is a misdemeanor in Canada, cause some misdemeanors in the US considered felony In Canada. However, as Canada recently legalized marijuana for recreational use, it will have absolutely no effect on your application if the amount you carried is allowed by the new law. This is my personal opinion.

It won't impact your application negatively. If it doesn't show up on your PCC, do mention in when answering the statutory questions, explain in the LOE.

I see. I believe I would have to answer those questions once I receive the ITA. I couldn't see any such while submitting the profile. Thanks for the advice!!

Did you declare it while submitting your PR application? If yes did they ask for anything else?
I have dismissed charges in USA. I was just trying to come out of local park through the fence like other people and officer saw and got mad apparently he was telling people not to through that whic I didn’t know. I got arrested for that stupid thing but my case got dismissed completely.
My FBI record do not show any arrest..should I declare this during my PR application?

based on my understanding, misdemeanor or fanlony, they droped all charges right ? So technically you don't have a cirmial record right ?
You can go on FBI website to pull out an identity history record to ensure and it only costs you $18 +postage. your fingure prints and SSN is required to get your record.

since you are in the U.S , you probably need this document in your application anyway.

Irrespective of whether it shows up in your criminal record or not, you need to be truthful when answering questions in your application.
