Here is the situation: I am the sponsor living in Canada, divorced with children.
Will be sponsoring my wife (no kids) who is living overseas.
She's filling out her forms and now at the IMM5406:

1- Section A-2: will she put me there under the spouse or common law partner ? I was thinking yes ?

2- Section B: I suppose they mean in case she has her own kids? or would she put my kids their because they are the kids of her husband who is me? So far I'm thinking to leave it blank?

3- Where to write "Not Applicable" ? Thinking to put it in every box that is left blank? that is in all the lines and rows of Section B. Also in some boxes asking for the emails as their parents will not have emails.

4- Can we write "Not Applicable" using the computer keyboard? we're filling up the pdf forms using on the computer. Or should we hand write it later after the form is filled out and printed out?

5- Where exactly to write the names in the native language ?

6- Does the address need to be a detailed long one? or just more or less the city and country ? otherwise the real postal address is long and doesn't seem to fit in the space allowed.

1. Yes......refer.....Spousal Sponsorship Guide.....IMM5406......section A.

2. Fill details of step children........refer.....Spousal Sponsorship Guide.....IMM5406......section B.

3. At the top of the form, you are asked.....if a section does not apply, write "Not Applicable"......if you don't any information to fill in a box, leave it blank, as the form does not require any validation......only fill and print.

4. you are only required to write "Not Applicable" if a section does not apply.......if you must write "Not Applicable".......you could fill on computer or write after printing.....but filling on computer is much better......the PA has a husband and kids, which leaves only section C, and if the PA has brothers or sisters, will advice you provide the details.

5. if no space, you may provide in an separate sheet.

6. Don't provide only city and country......try provide address that fits into space.......home/apartment #, address street, city, country

    • If you are married and your spouse was physically present at the marriage, write “married – physically present” in the marital status box

Another Question:

Was that a proxy marriage? Were you or her not there at the wedding?

Canada do not recognize proxy marriage.

Thank you folks for the answers, let me clarify some things and ask a bit more to avoid getting confused.

I did travel over there and met her and married over there (physically), so it was not an arranged marriage, then I returned back to Canada, so now and physically speaking we're in two different places, but I see the definition of "physically" is about attending the marriage not about where about we're living after that. So I will correct Section A for both the PA and Sponsor and put both as “married – physically present”.

1- Section A: Putting my name in the second line, the sponsor as her spouse....

2- Section B: For the children I am still unclear and unsure, the kids are mine (the sponsor) and she has no kids, because you wrote in your answer 4-... "the PA has a husband and kids.."... Does she (PA) has to put my kids even if she has not any of hers to bring ? I'm thinking this form like others is used for many different scenarios of immigration applications, not only for the case of sponsoring a spouse and in some of the cases they do have kids with them .... further more, when re-reading the guide it talks about "dependent" children,

Your wife (PA) definitely needs to list yours (sponsor) kids as her step-children in IMM 5406-Additional family information form. It even says on the form itself to list any children including step children even if they are Canadian citizens. And your children are your wife’s step children so need to be listed in this form. They don’t ask about just dependent children in this form, they ask about ANY children regardless of their age and citizenship.

Write the names in your language right under the names in English, in the same box.

If you both were present at the wedding ceremony then it’s married-physically present.

The actual IMM5406 clearly states to list all step-children. There is no confusing wording. You do seem to be overthinking things and complicating it instead of just following the instructions. Maybe think about taking a day off and just not looking at it. A break can really help when you start to overthink it all.

After you receive AOR with your UCI and application number send a new corrected IMM 5406 along with a letter explanation through webform. Just explain that you made a mistake and that you were actually present at your wedding and misunderstood the question. It shouldn’t delay the processing of your application much and as long as they got this correction they won’t refuse it on basis that it was “proxy”.

1-So your opinion to send the corrected one and I included my copy of my payment receipt now before even I get AOR1?
2- If so is that ok if my payment receipt showing the sponsor's name only because she did the payment ?

3- in IRCC Webform what I have to choose for this question
Is your application being processed by an office OUTSIDE Canada?
(Yes or No)?

My application still in sydney nova scotia Canada I didn't get AOR1

1. i would send it now to correct the mistake regardless on when IRCC will review.......with IRCC you never know......its just my opinion.

2. that's okay.....the sponsor showing on the receipt is good.

3. choose NO.....as your application may still be at Sydney, NS, Canada......but also include a note to explain in your mail and webform.....that you had earlier sent your application and only correcting a mistake, and have not received AOR.........IRCC usually send AOR within 6 to 8 weeks.
