Hi all!
Here’s my situation... my husband and I applied for a visitor visa last year 2017 and he was denied. They said they didn’t think he would return back to DR. We got married in April and shortly after I found out that we are pregnant and expecting. We had planned before to start the sponsorship process so that he could live in Canada with me, but we weren’t rushing it. However after finding out I am pregnant we decided to do it now. So we hired a lawyer to have everything completed correctly sent it in to Mississauga and they received it June 1 2018. Our lawyer advised us that it will take about 3-4 weeks for me to be approved and then we will get a file number. I’m so excited now because I really want to raise our baby here in Canada. I told my father and he is being so negative saying that my husband will be denied! I’m very hormonal and now I’m feeling so sad and worried. I’m hoping to hear good advice from people who have been recently approved to lift my spirits. Thanks in advance!

If you applied for spousal sponsorship outland and the sponsor is eligible to sponsor............your sponsorship will not be disapproved because your husband was denied visitor visa in 2017........your spousal sponsorship will be approved based on the proof and genuineness of your marriage/relationship.........if your lawyer submitted the required support documents as stated in the spousal sponsorship checklist..........if there are any issues you think may be raise a red flag, please inform your lawyer.......its very important to be honest with IRCC, like your lawyer must inform them in the application form imm5669 of the denied TRV in 2017.........relax........stop feeling so sad and worried, your health doesn't need it..........if your sponsorship application package received at IRCC Mississauga is complete, IRCC Mississauga will send the acknowledgement of receipt (AOR) within 6 to 8 weeks.

Yes we’ve sent in all the proof that our relationship is most definitely genuine as well our lawyer did inform of his visitors visa being denied.
You’re right my health or my baby doesn’t need the stress but it’s hard when my father is being so negative. He’s only speculating because he has no experience with this stuff. So I’m glad to have advice from people with experience it helps.

The only way your husband will be denied is if they determine the marriage is not genuine. A refused visitor visa has no effect on the application. Stuff that will affect it are red flags, such as short courtship before marriage, marriage on first visit, parents not attending wedding, wedding is a court wedding rather than a traditional one that follows cultural norms, one person previously married, other is newly wed, person being sponsored has history of attempting to come to Canada, couple has large age, educational, cultural difference. If you have a few of these red flags, chances are they may call your husband for an interview and will ask him a bunch of questions to determine if the marriage is genuine, and if not, he will be refused. If you guys have minimal to no red flags, the interview will not be needed, and he will get his PR visa soon.

As long as you submitted a strong application that addresses the red flags, you should be fine.

Also, having a lawyer doesn't necessarily mean the application was sent in correctly or that you will be processed faster. Many people here have had bad experiences with lawyers that keep forgetting documents or don't keep you up to date as to what's going on. I advise that you make sure you keep constant contact with him to make sure he doesn't miss any correspondence from CIC.

It seems like you are doing everything right! We are in a very similar situation, with the difference our little one is with us already.

I know it's easier said than done, but just have to be patient and keep positive for your baby! Everything is going to be great! Congratulations!

First of all congratulations for your wedding and baby on the way.

My husband arrived in November 2017, after a little less than 8 months after sending the application.

My parents did not attend the wedding either, because they/I was scared for them due to the situation in Honduras. As well I’m 9 years older than my husband. Things that can be considered as red flags.

We are together since 2012, we met here while he was on a work visa, he was here 2 times for 8 months and I went to live there for months. Got married in 2014. We’ve put a first application in 2015, but at the end of 2015 we separated so we withdrew it. We got back together sometime in 2016 and decided to reapply in March 2017.

I thought that for that reason as well they would think it’s a red flag, but it turn out that everything went well.

We explained everything about our relationship the ups and down of a long distance relationship why we separated.

In the notes from the agent he said that our relationship seemed genuine, that we had spent lots of time together and that we were honest about our story.

We didn’t have an interview. Even though we would have had one I was pretty confident as we know each other a lot and we’ve looked for possible interview questions and when we were going on the road when I was going there we were simulating interview. We were joking and learning stuff about each other at the same time.

It’s stressful and endless but at the end all worth the efforts, struggles. When he’s finally by your side and finally there’s no thinking about the end of the trip, the despedida at the airport, even though it’s a big adaptation for both it’s priceless!

It’s good to know that your parents not attending wasn’t a red flag. That’s reassuring.
Yes it’s stressful when things are out of your control especially with a baby in the picture but luckily hearing your stories really gives me more faith in the process.
My best friend is from Honduras btw
