In-land spousal sponsorship question

One of my friend is applying under in-land spousal sponsorship. She is living in Ontario and has full time job and her husband is in BC. Is this possible for her to submit open work permit application for her husband while they are not living together

I think you have to be living together to apply inland.

How is her husband supporting himself on his own in BC? Currently has some kind of work permit?

This is failing to meet the most basic eligibility requirements to qualify for an inland sponsorship application. When IRCC finds out, they will probably refuse the application. They must be cohabiting in a conjugal relationship. This means at the same physical location.

Apply under the Spouse or Common-Law Partner in Canada Class if your spouse or common-law partner:

  • lives with you in Canada
  • has valid immigration status in Canada
  • would like to apply for, and qualifies for, an Open Work Permit so that they can work while the application is being processed

124 A foreign national is a member of the spouse or common-law partner in Canada class if they

  • (a) are the spouse or common-law partner of a sponsor and cohabit with that sponsor in Canada;

The PR application will be refused. As said above, living together is the absolute most basic inland requirement. Tell them to withdraw and apply outland.
