Hi.
I am a Canadian citizen who got married to an amazing Indian man. I stayed in India and hired an agent in Canada to do the spouse sponsorship work for my husband. Came back to Canada after 3 yrs and found out that the agent hasn't even sent in the application. We did fill out papers and had his medical done. Plus, we have known the agent for a decade so didn't doubt him but we should have cuz every time we asked for the application number, he would say that its not his company policy and could not give it to us.

Now my husband is very upset and says that just come back to India....he is a CA there and has a decent job. Should I just go back and continue with the life or convince him to reapply? It is taking a heavy toll on ourselves as we miss each other terribly.

So, the best solution for you is to go back to India and continue with the life there, and while you can file an outland application from India. You are a Canadian Citizen, you don't have to remain in Canada to file a spousal sponsorship.

This time, do the application yourselves. There is no need for a consultant.

If the consultant is registered, you should consider filing a complaint.

Since I am in Canada right now, can I apply for a spouse sponsorship and then go to India? or do I have to stay here until the whole process is complete?

Yes, you can apply while you are in Canada, and you don't have to stay in Canada to wait the whole process to go through.
