Newly married wife, 2nd try for her getting Visitor Visa Q's

Background:
  • I'm Canadian, she's Chinese. We live in China together.
  • She applied last year when we weren't married.
First refusal, Summer 2017
  • Had my sister in Canada write a letter saying she will take care of her.
  • Got the GCMS notes: Said she had no/limited previous travel (only went to Cambodia). Not demonstrated sufficient ties to motivate return (only has a car). Not satisfied they will leave Canada at the end of the stay.
Situation now
  • Married to me (Canadian) in China
  • She's now been to Japan
  • Will have more funds to show as she will be on my bank account
  • Wedding photos of my family and sister with her in China .
  • Want to go together this summer for a few weeks.
Questions
  1. How can we demonstrate she has sufficient ties to return?
    Should I say I work in China and need to get back (ie her husband needs to return to China)?
    How about her night school? She has tests coming up.
  2. When applying I will choose the "family visit" and put my "sister-in-law" as the contact. Is there more I can do or do it in a better way? Will it look better if I put "mother/father-in-law"?

Why don't you sponsor her for immigration and forget about the visitor visa?

Because we still both live in China and we don't plan to move there until 2-3 years later. Or is it possible to sponsor without us both living there? And would it make sense in our case if we need to be there this August, ie enough time?

So I have done more reserach into the sponsoring of immigration and it needs 12 months, and we need to be in Canada for the Summer (for holiday), so I don't think that will work, I am correct in thinking this way?

If you don't plan on moving back to Canada then you can't sponsor her for Canadian PR yet. I believe that you have to prove that you plan on living in Canada to even qualify for sponsorship.

And yes we will, the plan is definitely there, but it seems it's not an option for this year as the process takes 12 months, so us going for a time in the Summer and returning to pack up our life to life in Canada is not going to happen via the PR route. Back to plan A of temp visa I guess?

Yea. I believe that a TRV is your only option for her in this case. I would write a letter to them when applying that outlines exactly why you two are going to Canada. Do you two own a house or are renting a place in China? If renting, show that the rental contract lasts past the time you will be in Canada. Will she still be enrolled in school during the time you plan on being in Canada? Show proof that she is enrolled for the next semester (since I assume you guys are going during her school break). Her having a job that she needs to get back to will help too. Some people have even gone so far as to give an itinerary of what they will be doing while they are in Canada.

Pretty much you need to show that she has no reason to want to stay in Canada illegally after the visa runs out. You have to show that you have commitments in China that you can't just drop easily.

You are a Canadian citizen living exclusively outside Canada and this makes you eligible to sponsor her for immigration. Once she got her landing visa, she can just buy a plane ticket and do a soft landing and return to China shortly. You both can return to China to wrap up things until the final move.

  1. My work contract is for 3 years, still have 2 years left. Do I also need a letter from my employer or?
  2. She actually has to attend a conference in Aug after we get back, she'll get her boss to add that in.
  3. Car registered in her name.
  4. Night school (self study though) does have exams, so will try and find the proof we need. Could be a bit hard this far out. @Sulwyn

Pictures of our relationship over the years, plus parents and sister attending our recent wedding.

Questions:
  1. Should I write the invitation letter or should my sister (who we will stay with in Canada) write it?
  2. Should I mention that she will do the Family Class immigration in approx 2 years time? as we are established here in China, I still have 2 years left on my contract. I am in a technology industry that here that Canada is not as developed as China, thus needing to gain more experience here first.
  3. When applying online for the visa, should I use my own email address, or hers? Or does it matter? It will be using my Canadian online banking as the secure token, so just checking.

Well, that will be a back up plan if she did not get visa again. You can start sponsoring right away and this has no effect on the visa application. You can continue working in China after her landing even though you intended to move as soon as she gets her landing visa. Many people including myself had been this situation,

Understood but wouldn't it be a contradiction if we write on the TRV app that we won't move to Canada for 2 years, but then we are still applying for Family Class at the same time? I get what you mean about intention but it seems like if they compared applications, it would be in direct contradiction, or am I overthinking it?

Don't bother applying for sponsorship at this point, as you would need to prove your intent to settle in Canada when your partner is approved, which you don't actually intend to do. Some get away with showing next to nothing while others are requested to show solid proofs. If IRCC isn't satisfied of your intent to return, they will just refuse the app.

Yes, I would recommend that you include evidence (in her application, of course) for your work contract + a leave approval letter from your employer + any critical work commitments that you must return to after the intended visit + your bank statements (to confirm salary transfers), etc

Is it possible for her to register for the conference before she applies for a TRV?
When do you intend to visit? Hopefully, you are not applying too much in advance


Car registered in her name.
Do include the car ownership documents + repayment statement.

Also, do include any other evidence:
Rent agreement, 2-3 recent rent receipts, highlight the bank transactions on the bank statement + if her family is financially dependent on her + any personal/family commitments that she must return to after her visit (evidence is required)

Do include evidence of enrollment + tuition fee receipt + exam fee receipt and exam schedule, etc.

If this is an online program, it won't really help much as a tie to return to.

You can mention you don't intend to apply for spousal PR just yet. Do be careful about how you word this from a long-term perspective keeping in mind her PR application later.

You can also include a small explanation/evidence on the monetary/career benefits that you are hoping to achieve by staying in China for the next two years + something similar for her career
