Hi,

I am a Canadian Citizen and living with my family in Edmonton, Alberta. Me and my husband both do full time job here.

I want to bring my sister's family here and they are working on their skilled category PR but not yet submitted any papers. My brother in law is the main applicant and his consultant suggested him to get 7.5 band in IELTS but he got 6.5 and my sister, dependent also give IELTS exams and she scored also 6.5 band.. But now their consultant is saying that my brother in law must have 7.5 so he has to appear again otherwise he cant apply.

Does anyone knows if I apply for their sponsorship also, how that works.. Does anyone has any experience?

Please update with your experiences and knowledge.

Thanks

Meena

You cannot sponsor your sister or her family.

If they wish to immigrate, they will have to apply on their own through an economic immigration stream like Express Entry. They will get additional points under Express Entry for having family in Canada.

I read this note on CIC website and looks like we can sponsor brothers and sisters too....

Sponsorship of members of the Family Class
The Canadian government allows citizens and permanent residents of Canada to sponsor members of the family class, but it requires that arriving immigrants receive care and support from their sponsors.

Members of the family class include a sponsor’s spouse, common-law partner or conjugal partner; a dependent child of the sponsor; the sponsor’s mother or father; a person the sponsor intends to adopt; and other relatives of the sponsor as defined by regulation.

Whom may I sponsor using this application package?
You can use this application package to sponsor:

  • a child whom you adopted outside Canada and you were a Canadian citizen or permanent resident living in Canada at the time the adoption took place, or a child whom you intend to adopt in Canada. Consult the Appendix A.
  • your brother or sister, nephew or niece, grandson or granddaughter, if he or she is an orphan, under 18 years of age and not married or in a common-law relationship;
  • any other person, regardless of age, with whom you have a family relationship if you do not have a spouse, common-law partner, conjugal partner, son, daughter, mother, father, brother, sister, grandfather, grandmother, uncle, aunt, niece or nephew who is a Canadian citizen, a registered Indian, a permanent resident or whom you may sponsor as a member of the family class.

You've misunderstood the requirements. You would only be able to sponsor your sister if you met all of the requirements below:

- you have no spouse or common law partner
- you have no children
- both of your parents are deceased
- you have no other family living in Canada (e.g. aunt uncle)

You have a husband and therefore do not meet the requirements to sponsor your sister. Again, they will have to qualify to immigrate independently through an economic stream.

This requirement is in the last bullet you quoted:
  • any other person, regardless of age, with whom you have a family relationship if you do not have a spouse, common-law partner, conjugal partner, son, daughter, mother, father, brother, sister, grandfather, grandmother, uncle, aunt, niece or nephew who is a Canadian citizen, a registered Indian, a permanent resident or whom you may sponsor as a member of the family class.
You have a spouse - therefore you cannot sponsor your sister.

He can take extra language classes to improve his English skills. The Family Class Sponsorship is not an option for him.

I would recommend you post those questions to the Express Entry forum since they are about qualifying for that program. I suspect your brother-in-law's points are probably too low to be selected through EE and that's why the consultant is telling him to take IELTS again and achieve a higher score.

He would need to qualify for and apply to one of the current economic immigration streams (like Express Entry, PNP, etc). This will require him to meet certain English levels, and have necessary education and skilled work experience to qualify.

Info on all of Canada's immigration streams are here: https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada.html

Yeah he will b appearing for another test soon.. So if spouse also appear for IELTS exam and get good score, does that helps in immigration points?

Again, you need to move over to the Express Entry section of the forum. This is where the CRS points system is discussed.

You have to apply for Express Entry if you are applying through the Federal Skilled Worker program. You cannot apply to FSW directly. He needs to do more reading / research to understand the application process. Again, please join the Express Entry section of the forum.
