Appeal For Reconsideration of ITA Application

Hello, everyone.

CIC rejected our ITA application on July 25, 2017 with an outdated FBI Identity History Summary Check (police certificate) as main basis. Truth is, I, the principal applicant, applied for this FBI police certificate on April 27 (we still don't have it to this day because the FBI asked for a new set of biometrics because the first set I submitted was not clear/indecipherable. I submitted the second set of fingerprints on September 13).

Our immigration advisor bungled the opportunity when he failed to tell us to advise the Canadian government a new FBI police certificate was already in process. Our deadline for the ITA documents was on July 12, 2017.

We received the rejection notice on July 25. My representatives and I filed an appeal for reconsideration on July 31 which includes evidence I applied for a new FBI police certificate last April (waybill, email from courier, invoice, etc.).

However, we received the refund for the immigrant visa fees a month after we filed the appeal. Our advisor (the same moron) just told me that's a sign the appeal for reconsideration no longer has a chance.

Is he right? I certainly hope not.

As of this writing, we are back in the Express Entry Pool hoping for a qualified job offer or provincial nomination. Wish us luck. Thanks.

Sad to learn that you had to go through a nightmare- The very 1st thing you ought to do is fire that immigration advisor for ineptitude.

As you haven't yet received a reply, it could be true that your case was a rejection- Rejection as a result of PCC's ranks No.1 amongst all reasons, unfortunately.

Glad to learn at the same time that you're application is now in the EE pool- just wait it out, and certain you'd get it. All the best.

agreed, fire this advisor and restart the process on your own. it doesn't mean you didn't have a chance, just that your refund was processed. it won't "affect" your application. fire the advisor restart the process on your own. you already have all the paperwork ready so just go for it
