Hello All,

I have been a PR in Canada since 2016 and would like to sponsor my parents next year (when the PGP opens).
I had a few questions regarding the same and hoping I can get some answers here.

- As for the MNI (LICO), I am assuming it would be for the years 2014,15,16. Is that correct?
- Based on my situation, I was working in different countries before moving here but for the year 2014 and 2016 i worked only half of the year, and then this year (which would not be considered). So would I have to wait until 2019?

If there are any other things to consider for me regarding this, please do let me know

For 2018 you will probably need NOA's from 2014, 2015, and 2016
If you have only been in Canada since 2016 you will need to wait until 2020 if the rules do not change

Correct.

Income earned while not living in Canada, does not count.

Assuming your 2016 income doesn't qualify (since only half a year), with qualifying income in 2017, 2018 and 2019 you can possibly apply to the lottery only in January 2021

You would have to wait until 2021 based on this information and assuming that you do not have a break in any year of missing the income cut off

5.31. Exceptions to Canadian income rule The exceptions to the Canadian income rule are as follows:
• sponsors who commute from Canada to work in the U.S.A. can use their U.S. employment income provided it is declared as income on their Canadian income tax return;
• sponsors living in Canada who declare income from foreign sources on their Canadian tax returns, can use this foreign income to meet the financial requirements for sponsorship.

Discretionary approval of financial requirements is not possible.

That is only because in 2017 they took so long to figure the lottery out, everyone had their 2016 taxes completed by the time apps were submitted.

There is a strong chance in 2018 they will follow the old rules, so you may require 2014, 2015 and 2016 income again to apply in 2018. Wait until December when new rules come out.

is that mean that i definitely have to live in Canada a least 3 years ? because i don't see this rule in the requirement. i just become a RP so it's not possible to apply for 2018 ?

Yes because you need the NOAs, which is the only proof of income they will accept, and no way to get 3 yrs of NOAs unless you've been a PR at least 3 yrs

If you have a Canadian citizen or PR spouse that meets Canadian income requirements for past 3 years, then if they are co-signer you can apply for lottery immediately.

However if you don't have spouse that meets income criteria, you need 3 years of income earned in Canada before you qualify to enter the lottery. So if you get a job meeting LICO income starting in 2018, you may be able to enter the lottery in January 2021 or 2022.

Or if you happen to live in Quebec, they only require 1 year of Canadian income.

Hi guys, quick question: If my parents dont have a marriage certificate, is there an alternative? I looked at Form IMM 5409. but that seems to be for Common Law only? Or, is that form still applicable in my situation? Would greatly appreciate any suggestions. Thanks!

i applied for my parents aplication under pgp 2018 and got the AOR and now immigration asked me to send this form

but i am not able to find this form

plz anybody know where to find this form
