Visitor visa refused

Hi...

Someone please help. I am really desperate right now.

I am in Canada on PR and I applied for the visitor visa for my common law partner to visit me for three weeks for christmas and new year. We provided his employment information, return ticket, vacation letter from work and family information back home. But he was refused the visa on the ground that he has not satisfied immigration that he will go back at the end of his visa. They said in the letter that he can reapply if he can show that he will go back.

We have reapplied immediately writing a letter saying that his parents are old and he is the one looking after them, and also that he is a government employee and has no reason to quit his job.

How likely that immigration reverses a decision?

Thank you

Hi,

Hopefully your partner will be approved this time. That said, it is not a good idea to rush another TRV application without addressing the previous refusal reasons. Too many application in haste can make it look like desperation with the hidden intention of perhaps wanting to apply for inland PR.

Also, explanations/letters don't work. Hard evidence impacts a visa decision. Hopefully, he has included evidence that he takes care of his parents, especially if they have some critical medical conditions + other evidence to prove that he must return to his home country

Cheers

Actually as a government official back home, he is eligible to take a specific loan for which one of the conditions is that the monthly payment is deductible straight from his pay. At any time that this is not deducted automatically, for example if he quits his job, the remaining loan becomes fully payable. He has taken that loan, and he has also explained all the functionning of this loan in the letter, as well as how he cannot afford to quit his job right now because of that loan.

Also, being a police officer back home, he has also explained that there are strict rules regarding leaving the employment, like there is a strict procedure for handing over of police materials etc which if not done properly can lead to arrest at the airport anytime he travels. That too he has explained in the letter.

Fantastic (as a reason to return home).

In addition to the explanation, has he also submitted?
1. Loan repayment statement
2. Government documents that state his eligibility for a loan + the terms/conditions
3. Loan documents

Again, letters don't work in isolation without evidence.

The rules he has explained in the letter are universal and would apply to police officers in any country. Has he (for example) submitted evidence that he has been issued police material/guns/similar items and he is mandated to return these items through a strict returns procedure?

I would focus more on the parents + general employment + loans repayment + any other ties (property/land, financials, etc) instead of the police material as a reason to return

He submitted pay stubs and in his letter he referred to the description of the loan payment that can be seen in the pay stubs.
With respect to your note about hasty application, he already bought the non refundable return ticket for christmas and new year. Thats why he thought it better to reapply asap.

To reiterate: Explanations/letters will not work if he does not substantiate the statements with evidence.

I would recommend he submit the evidence/suggestions I have given in the previous post ASAP. He could email the relevant visa office and request for these additional documents to be considered.

His pay stubs didn't help for the first application = The visa officer is looking for more concrete reasons for your partner to return home.

Confirmed flight bookings do not guarantee a TRV approval nor an expedited visa decision.

On a side note:
Did the processing of his first TRV application take longer than the IRCC published time?

No. It took around the same time.
