Marriage Misrepresentation

Hello Guys.. I am new to this group. I have a case specific enquiry relating to my PR application.

I applied through PNP Ontario in Feb 2016. At that time when I firstly filled EE profile I included my wife as spouse. But later I realized because of including her in my application my CRS score went down below to the 400 mark. In those days I have also received PNP notification from Ontario. So I decided to not to show wife as it wasn't any where in papers. Well every thing was going well I got 600 points and sooner I got ITA. I made application and got AOR in April 2017. Medical Passed in July 2017. Later I saw My wife's name in Dependent which I clearly remember I didn't show while making final submission. Then I wrote CIC through Web Enquiry that I didn't show .... person as my wife. Later it disappeared from my EE Profile I am sure it was not because of my Web Enquiry. Well. things gone well. Yesterday I got email to submit Divorce certificate if I was previously married. I am very confused now. Any valuable suggestions how to go about it. I have only seven days.

It was mandatory that you include your wife in your application and that she pass the medical and provide PCC. However you did have the option of either flagging her as accompanying or non-accompanying. If you simply left her off the application completely - that's misrepresentation.

If you left your wife's name off the application completely - I would withdraw the application. Otherwise CIC may make a finding of misrepresentation and ban you from Canada for 5 years.

thanks for the suggestion. I met a immigration consultant he advised me to write a letter and state the actual reasons why you have done this... In either case I will be peanlized I know but is it advisable to write in CSE.

I would try to withdraw. If you withdraw - there's a chance you won't get a misrepresentation finding.

If you write the letter instead, the I think the chances of a misrepresentation finding and five year ban will increase significantly.

Your life - your choice.

Can we withdraw at this stage. Because that consultant said you would want to open your doors so tell them truth what actually happened. I know about refusal and already made mind. I made a mess which could have been easily dealt with. But whats the safest way now... I am very much confused and tensed. Cant figure out the way out....

Even if you withdraw you will face the consequences. Cause when you apply again you have to specify previous application and they will see the old old application and everything unravels. Go with an immigration lawyer and make your case and get out of it in a legal way.

Now the most important thing you want is not to get banned for sometime. And you lost your pnp good bro.

Dont make any decision. Let the lawyer fight your cause.

I have only 7 days to reply.. I went to some lawyer they all said its difficult. I know refusal is confirmed along with 5 years ban..

1. You said you are not married ? Is this correct.
2. If (1) is correct. Do you have a marriage certificate and wahts the date?
3. If you have 2, which country you are married.

You took away another well deserved applicant's place and tried to backdoor-enter yourself into the pool. I have no words to say on this. Withdraw your application and write a detailed LOE as to what happened. Next time be cautious about what you do, because the consequences would be much worse than what you expected. How would you feel if your position on the express entry pool was taken away by some random applicant who found a way to lie and increase his/her CRS score?

What was your intention here actually?? I mean just because you did not have your marriage in paper (your words here, and this does not deny the fact that you are indeed married to a human being), you thought that you could lie and go ahead with your application is it??

CIC is not just some private 3-employee organization which does not cross-check applications before going to the next step.

My humble suggestion, your best course of action would be to decline the ITA, create a fresh EE Profile and add your wife details in them. Do the ECA and medicals for your wife at the earliest. Before you know you might get another ITA. Good luck.

You should have made wife as non accompanying and your CRS should have been as unmarried, But by mentioning your wife as non accompanying you had a chance to sponsor her latter.Now just withdraw the application

You knowingly did unethical and wrong thing. Withdraw the application and file and honest application before either CIC finds it out and bans you or somebody from here reports it to CIC and they ban you. And yes, next time when you fill any kind of application be honest - don't lie ever in life, you will be more safe and relieved.

if that wasn't (also)the way things are done in the world,then there wouldn't be lawyers in the world...
I am purely objectively giving a way out...of course first raise a cse stating that he's withdrawing & give the reasons...his call...
he acted out of eagerness to be there ahead of many,still I don't mind suggesting a way out..of 5 yr ban

Don't judge the guy base on his one mistake. When I first come outside my country, I even rode my bicycle on the freeway because I don't know what is the freeway. The freeway concept is mind blown to me since where I came from don't have it. You don't know that guy background or what was threatening him at that time, so stop judging him.

He make a mistake and he acknowledged it, why don't you just forgive him and help him to make it right.
