(Had also posted this in the Family Class forum - forgot about this visitor section - someone reminded me i should try posting here!)

Hoping someone here can advise me of my options....

I have just today received a message in my CIC account telling me i have been refused an extension to my visitor status/record. I applied for my extension in May 15th, before my visitor record status ran out.

My current situation is that i have been all ready to apply for PR via common law sponsorship (outland) for a number of months but we are awaiting my partners 2016 NOA and have been for a ridiculous amount of time now. We were ready to submit in May /June but thought it best to wait to receive the 2016 NOA as had seen many cases of people having their applications returned due to the NOA not being the most recent (we didn't want to send the 2015 one). Unfortunately my partners taxes appear to have been chosen for random checking and we have now been awaiting his NOA for over 2 months, which has really messed things up.

Totally devastated to receive the refusal today and now have no idea where i stand or what to do. I am knowledgable about the immigration process but this is something i never envisioned having to deal with.

I have been trying to look up about restoration of status or appealing the refusal but i really cant find any recent or definitive answers on it, neither on this forum or elsewhere (not any that makes sense to me anyway). Can i appeal? Do i have to restore my status? Can i reapply immediately for a visitor record if i transfer some UK funds, just submit my PR app with 2015 NOA to show my intention.)

The refusal letter was generic and doesn't state anything specific to my case. There is a part in bold which im not sure if this is to tell me the reason thats relevant to me or just a error. The emboldened part is "reason for requested extension".

Please help! I dont know what to do and am now frantic! :(

Thank you!

(FYI im from the UK, living in Canada)

If you want to remain in Canada without leaving - you have to apply to restore your status. Since you were refused, you are in Canada without status now - so restoration is a must. Apply soon. You only have a 90 day window from the time you're refused to do so and best not to wait until the last minute in case the application is returned due to any errors. Yes - showing increased proof of funds wouldn't be a bad idea.

Thanks scylla! To say there has been a lot of tears and panicking the past 24 hours is an understatement. Felt like all hope was lost.

Ok so i can apply to restore my status? I was reading something about having to do that within 90 days but i wasn't sure if that meant 90 days from when i submitted my extension application or 90 days from when i received my refusal?

PR app wise; Can i (would i be best to) submit my restoration of status app with my outland PR app if i get my partners NOA (as mentioned this is what is stopping me sending it in). Can i do that? There is no telling when we will receive it but i can only hope its very soon. If we dont receive it within the next few weeks i would be tempted to just send all the tax paperwork we have (his accountant gave us a filing confirmation thats shows his line 150) and a letter of explanation saying that CRA have taken over 2 months to send it to us.

Is there a chance they would deny my request for restoration of status? What then? It seems crazy that they could simply refuse my extension but then restore my status anyway.

I really dont want to have to leave Canada and return to Scotland.

How does all this affect a future PR application? Does a refusal/restoration of status go against me in any way?

Sorry for all the questions but as i said i felt pretty clued up on the whole process, but never looked into this side of it, i hoped id never have to. So grateful to have this forum as its the only place i find i get actual information.

Thanks again.

Hey! So sorry to hear what has happened to you recently. What were the reasons as to why they denied your visitor extension?

They didn't give an actual reason..the refusal is a generic template letter that i received in my CIC account. As stated in my original post it doesn't state anything specific to my case. There is a part in bold which im not sure if this is to tell me the reason thats relevant to me or just a error. The emboldened part is "reason for requested extension".

What i am wondering is why they need an NOA. Usually bank statements from either your boyfriend you or your partners parents (if you're living with them) and a letter of support proving they will provide for you during your visit will suffice. I would give them a call and find out as much information as you can. Do not worry and do not be upset. All will work out in the end Canada is very generous in the sense of family or loved ones.

The NOA is related to my PR application NOT my visitor record/visa.

Ok, no problem just apply to restore your status that's what everyone is going to say to do honestly. It is very important that you continue staying with your partner as long as possible. (Of course you don't have to) I'm just saying what I think. How long did you wait before your visitor extension was refused?

Where are you from? I think you would be fine to restore your status if what you’re stating is true. That seems like more of a legitimate reason to consider restoration.. Others might say otherwise but honestly I feel like you should be fine are you a US citizen? Usually they aren’t so harsh on US residents.

Doesn’t matter if you have a US passport or not. Your still a foreign national and require a valid passport to remain in Canada and/or apply for an extension or restoration.

Hello. I entered Canada last June 15, 2017 with a tourist visa. My mom is a diplomat and works at the Philippine Embassy. My visa was expired last April 29, 2018 and prior to that I was accepted at Algonquin College. I wanted to go to school again to further my education and as well as to remain in Canada with my family.

So I applied to change conditions, extend my stay or remain in Canada as a Student and submitted my application April 25, 2018. Unfortunately, I was refused. The letter said that I am not a person described in Immigration Legislation who can apply for this type of document within Canada and I was supposed to apply outside Canada.

Now, I’m at a loss and I don’t know what to do. The letter also said that I need to leave Canada immediately since I have no legal status here now.

Can anyone please help and advice me of what I can do next?

Oh, also last December 10, 2017 I exited Canada (a friend of ours informed us that the longest you can stay in Canada is 6 months and that you have to exit and just re enter again) and re-entered Canada, December 18, 2017. Does that mean another 6 months for me to stay here?

Thank you in advance.

Yes, the entry in Dec gave you another 6 months. How old are you?
