Hi All,

Just need some clarification on how to interpret this link:

http://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=664&top=29

To be eligible for permanent residence under the Canadian Experience Class you must have completed, within the three years before you apply, at least:

  • 12 months of full-time work:
  • 30 hours/week for 12 months = 1 year full time (1,560 hours), OR
  • equal amount in part-time hours, such as:
  • 15 hours/week for 24 months = 1 year full time (1,560 hours)
  • 30 hours/week for 12 months at more than 1 job = 1 year full time (1,560 hours)

You must also complete an Express Entry profile.
So, I my last day as an FT employee was on February 29th, 2016. Does that mean I have 3 years from that date (in my case Feb 28th, 2019) to apply under CEC? After that it would be classed as FSW or completely invalid for any stream?

If correct then I could hold back on applying and the only things I would need to redo is the medical and IELTS tests.

When did you start your job? My understanding is that if you apply on Feb 28 2019, your work experience would need to be between Feb 28 2016 and Feb 28 2019, which is not the case here.

Don't think you can use Canadian experience for FSW.

No - it doesn't mean that. It means that if your experience is from Feb 2015 to Feb 2016 - then you have until Jan/Feb 2018 to apply.

Note that rules change all of the time. So just because this work experience is valid now - doesn't mean the rules will be the same in the future.

I started in January 14, 2015 and ended on February 29, 2016.

So if I applied from March 2018 does it mean I can still apply for PR but just under FSW as I wouldn't meet the CEC requirements?

EDIT: My first attempt was rejected as incomplete and I am waiting for the fees to be refunded to me before I submit.

Just because you will not be able to apply under CEC does not mean that you cannot apply as FSW. In fact, if you decide to apply after you get out that 3-year time period, then you will become a potential FSW candidate, and you can definitely use your Canadian work experience to apply for PR.

I would suggest not waiting for the fees to be refunded, and submit an application right away. You will get your refund back at some point, but I personally would not wait for that to happen. When it comes to immigration, every second is valuable, as somebody else pointed out that rules change all the time.
