visa ends 2 days short of 12 month cohabitation

Hi!

My work and travel visa in Germany is strictly one year long, and because I ended up flying to Germany two days after my visa started, I will have to leave, having spent 2 days less than a full year in the country. My partner and I are using this year as our '12 months cohabitation' to prove common law status. Will this missing 2 days be a problem?

Could be or could be not. They require 365 days of cohabitation. Sometimes 1 day off could be fine, buy 2 days, I am not sure. Any chance you can extend this? Have your partner join you when you go back home.

Don't apply for less than 365. You need a minimum of 365 days to be considered common law. Apply to change your status to visitor and stay at least a few additional days to make sure you have the full year.

Thanks! Ok they are serious about this eh - I can't change to visitor status after a work and travel visa, so I guess I will just have to make sure my partner travels with me when I head back to Canada.

Yes, and you could also extend the cohabitation while you gather all documentation, proof. Now that she plans on coming back with you to Canada,you guys can also apply as common-law, inland and include an OWP app for her.
