Hello there,
Today CIC requested me to submit Medical Exam results of my spouse. She had done exam last year and it expired last month while Application was under process.

Problem starts here,
I've applied as Non-Accompanying spouse because things didn't go well between us and we are taking divorce. I was been waiting desperately for PR so afterword I could initiate divorce process from here. Her family been consistently pushing me to start divorce asap and lot stress from mine family too. I am sure she's not gonna cooperate me anyhow for medical exam because of her family pressure. Only choice left is to decline ITA and process now and take divorce first..
Please give me advice what else can be done in this situation.

If you applied with your spouse not accompanying the it seems like cic made a mistake.

They don't need her to do a medical as she's not joining you? Maybe just query it with them

No mistake. Whether the spouse is accompanying or not he/she still requires a medical.

Really? That's weird since the medical is purely to see if they will be a stress on the system but if they aren't going it seems redundant
Spouse and kids do medicals even when not accompanying. And they assess for excessive demand too. This is to avoid a loophole later as if he sponsored them later on they will be excessive demand exempt. So they decide from now, if they are inadmissible, you are inadmissible too.

No mistake. Non-accompanying spouses still have to complete the medical.

Best thing to do is get the divorce asap and apply, explaining the change in marital status to exclude her.

If you want to continue with your current application, she either needs to complete the medical OR you need to provide proof that you have started divorce proceedings so that she can be removed from your application entirely.

They can be sponsored later through spousal sponsorship. So they will be a stress on the system later.

I don't think they will accept proof of divorce proceeding. They need divorce certificate, Until and unless they can't consider

Ive talk to few lawyer before I applied. Their opinions were different. One told'Its okey to show them proof of divorce proceeding and others were consistent with Divorce certificate. Do you have any idea?

apply divorce and show them paper that divorce application in process. and meanwhile try to get medical of your spouse if possible. and give an explanation letter.
