My question is I'm a convention accepted refugee in canada. I'm waiting for my Permanent resident status i have been previously married in Singapore and have filed a sepration in quebec and got the finalised separation judgment from court and already file a divorce in march 2017 and it's been 15 months that i have living apart from my ex- Husband i am in relationships with my new boyfriend and we want to marry each other. Now the court is taking so long to finalised the divorce process. Is it legal to live in common law relationship he is permanent resident of canada and i want him to sponsor under family law so that i can withdraw my refugee status.he lives in Toronto and i live in montreal but every second week we visit each other bcz I'm working here and he's working there or do we need to live together in order to apply under common law relationship?i need your advice. Yes you can qualify as common-law while being married to someone else, as long as that marriage has broken down.
However you don't qualify as common-law. You must live with your partner full time for 12 consecutive months. Vising each other a lot doesn't count. So you can only start counting the 12 months, once you move in with each other.
