I am just curious, I keep reading the background checks are done in Stage 2 after Stage 1 approval. I am in stage 1 and have not heard anything back about approval but I keep getting the message “we are processing your background check. We are verifying your eligibility” How can it be if I am only in stage 1?

“we are processing your background check means your application is in process now and assigned to officer. You will have stage 1 decision soon.

  • My spouse and I are settled in Canada, and we’ve built a stable life here for our family.
  • I currently hold a valid work permit, and my employer is very supportive—they’ve obtained multiple LMIAs in the past and are willing to help me however they can.
  • We are active in our local community, have no criminal record, and have done our best to fully integrate into Canadian society.
Given these circumstances, do you think I have a strong enough case to apply for PR under H&C grounds?
Any advice or similar experiences would be greatly appreciated.

Your circumstances are very compelling. However, you are a CNC machinist and there are pathways that lead to PR for you via skilled trade routes… H&C is not a backdoor to PR and the fact that you are already here as a skilled tradesperson could very well make the officer not approve your case because you can obtain your PR other ways. I understand that going back to Yugoslavia is not ideal for you due to lack of support of social programs for those diagnosed with Autism. However, I think you should speak to a consultant and figure out a plan on how to obtain PR through other programs first before trying H&C.

I made an express entry profile 2 years ago. Given that they deducted 50 lmia points, now I have only 275 crs.
I reached 30 yo last week, so I guess I have even less now. I stand no chance on express entry.

How is it so low? If you have Canadian work exp, foriegn work exp, etc IELTS (for both of you) - 275 is quite low. I'll check how someone can have so low CRS at your age. But, I was 30+ when I migrated to Canada through EE when CRS was easily 500+ as an outland applicant. I think there's a lot of space for you to get in through EE if you learn french, fix what's keeping your CRS low.

You two have made some choices in the past that might make you feel you can't compete via EE, but if you open up more steps towards fixing your lack of degree + do french, you'll likely get a PR.

im not saying its impossible. but its really hard for me, my life is already stressful enough.... I don't know, I get anxious a lot when I think about my whole situation...

H&C would be harder and more nerve-wrecking tbh as we can see over these threads. The wait times are longer and the result is very unpredictable. Once you apply for H&C, you'll also risk the ability to get a work permit extended in Canada too. So, ideally you would want to max out your options before going for a route that's a hard "yes" or "no" (given that it will make it very difficult for you to get a WP in future).

Learning french takes 9 months to 24 months, I've linked out to MushyMush's old 2022 french learning thread on the topic as well. I learned french and came here as well. I'd argue that this would be a much simpler route for you given that it opens up more options (vs closing them like how H&C does). You've a spouse who can potentially do it if you can't. If one of you is free, they can also get a degree from either Canada or back-home. All of these options open up more paths before you decide to risk with H&C.

Upto you on what you decide. Just sharing some options in case if you want to probe this a bit more before you decide what next steps you really want to take here.
 
Police may check up anytime at someone's house without notice,it happened to me before, I heard a knock on my door one day,I looked through the window and saw two policemen one at the door the other one moping around near the other window.I opened the door,they said someone called 911 and it is from my apartment, I said I didn't call 911 and it wasn't from here,they said can we come in,one of them came into the house asking the same question,they said a lady called 911 and hung up,are you sure it is not your wife,I said no, they asked me,how many people in the house,I told them only my children but wife not at home..
They said can we see your ID, I went to bring my ID,one followed me and stopped half way close to the room,I gave them my ID, they made a call but I don't know who they called,but gave the person the name on my ID and returned it to me and left.

Do you have any other reason of hardship you could experience if you return to Yugoslavia? Are you a member of a minority group that faces issues? For example, a Jew or Romani Gypsy? Was your family directly affected by the Serbian genocide in the 90s and you are still experiencing family trauma from this that has adversely affected your life there?

Thank you sir. One more question, why do you think it would be difficult to extend my work permit if I get rejected on H&C? My employer is willing to make another lmia for me.

I also vote for learning French to a CLB7 level to qualify for the French language EE draws. The H&C path is very long and very uncertain.
