It took place in Pakistan. I was in Pakistan and we had ceremony there.
So, it sounds like there may be a requirement for marriages in Pakistan that you are missing. You have to provide that to prove that your marriage is valid in Pakistan for it to be recognized in Canada.

Hi all,

I applied June 21, 2024. Anyone get their p1 this week? I haven’t seen a lot of movement in the reddit threads I am a part of.

Please I need advice and assistance.
I am a PR here in Canada and intend to sponsor my wife to join me. My story is a bit peculiar. I got married 2 days before I traveled and landed in Canada as a permanent resident. I had to get married due to financial and economic issues and couldn't bring my spouse with me. I also overlooked adding her to my application at the time. I only realized this when I decided to check on the requirements, and found out even marriages hours before confirmation of PR must be declared.
What are my best options?
I got married on the 5th of March and became a PR on the 7th of March

You cannot sponsor her. She will need to qualify for PR on her own through an economic immigration stream like Express Entry or PNP.

Won't humanitarian and compassionate reasons apply here? Getting PR on her own might be a stretch doing credential evaluation and writing English tests and all

How did you get your PR? Were you sponsored by a family? Or under economic streams?

You free to try applying to sponsor her with H&C considerations but extremely unlikely to work.

Note that you technically committed misrepresentation by landing on a visa issued to a single person when you were in fact married. However historically, we haven't seen IRCC go after people for this.

I had no idea I was to declare it but with everything going on, I didn't know. So is H&C my best bet or I can try for the usual family class sponsorship and back up my application with enough evidence and plead for genuine oversight?
Also, just a thought, I got a customary court certificate for the wedding done and the date is for after I became I PR (error from my country) can I use this instead even if I don't have travel records to back it up?

A PR application under H&C can only be submitted if the applicant is physically in Canada. Since your spouse is outside of Canada, you would need to apply for spousal sponsorship outland with H&C considerations. I would recommend you hire an immigration lawyer to help you. The chances the application will be approved will be extremely low, as mentioned, so your spouse should also focus on qualifying for PR through an economic immigration stream.

No, do not change the court certificate for the wedding. This is misrepresentation which would carry a five year ban for your spouse. This is a very bad idea and would mean you are committing fraud.

Thanks for this. So my best options are either applying for family class outland sponsorship with H&C considerations or hire an immigration lawyer?

There are multiple stages and docs where IRCC tells applicants that if their family situation / marital status changes that they MUST communicate it to IRCC.

Grab your COPR and look at it now: in the section personal details, first line is marital status. Further down is a section 'dependant(s) information' - and on the ones I've seen, a sentence below in bold "Have you any dependants other than those listed below?'.

Then at the bottom, where you sign, there is the following text "I hereby certify that the above statements are true and correct and that I fully understand the conditions imposed."

So you certified untrue information.

That's why I said I didn't really know. It was all rushed and done due to my financial situation
