yeah , hope they will underStand the reconsideration,

if i go for reconsideration and the file is opened do the processing timeline goes back to the original workpermit times like 20 weeks or for the reconsideration request they have to reply faster.

Don’t know. It is not under any processing timelines.

Yes , Im looking to go for reconsideration as they have goven refusal on wrong basis saying that my job is not under noc o a b , but my job is under noc b category. I will submit current job letter as well again to confirm my noc code with them.
Think the issue may be about the proof of being common law. Things like photos and calls aren’t proof. I would order GCMS notes. With your previous interactions with IRCC did you declare you were common law? Did you live together for 1 year or more?

Yes in the rent agreement was for 1 year on both or our names which states that we lived together for 1 year outside canada and paid utilities, bills together , joint bank accounts, and all that .

and after I came to Canada we want to reunite again .

If you read the refusal reason could be that they don’t believe you are common law or that you aren’t employed in NOC 0,A or B. I would order GCMS notes to hopefully gain insight.

If it exactly one year that often requires additional proof. Did you submit records for the duration of your 1 year of cohabitation especially the start date and up to end date of things like utility bills in either of your names, declaring status on any tax records or government registration, etc. Still would recommend getting GCMS notes even if applying for reconsideration in case that is refused.

But on the refusal reason they have mentioned only about that the job is not under the noc .
The refusal you posted states:
Eligibility for a work permit in this category only applies to the spouse or common-law
partner of a work permit holder
who is doing work that is at a level that falls within National
Occupational Classification (NOC) skill levels 0, A or B.


There are 2 potential refusal reasons: not believing you are common law or not working in the right occupation to qualify for SOWP.

Would get a lawyer if they don’t believe you are common law. You need professional advice especially if you have not lived together in a long time.
