I’m not sure if I understand what you’re asking fully but we did request for the same officer to review our PRRA and H&C applications. They were both rejected on the same day, which may be the reason why CBSA informed us of the H&C decisions instead of IRCC.

Still doesn’t make sense unless you were never eligible to apply for H&C.

CBSA didn’t seem surprised. We were very surprised and emotional but the officer just sat then left to let us process the news while she got our other documents that she was missing. My lawyer was also very confused because she didn’t expect for us to receive news of the H&C from CBSA.

Still doesn’t make sense why IRCC would not have notified you of the H&C refusal. Would call IRCC and ask when your H&.C refusal letter was sent and to whom. You could also order GCMS notes. When exactly did you meet with CBSA? Might be related to postal strike but would have been in the mail already if dated October 31st. You need to figure this out in case the JR gets denied because it was filed late. Not sure if there were special allowances due to the postal strike.

BTW As long as I understand there is no guarantee depending on how long you wait.
some applications got rejected in 6 months some of them after 28 months.

Of course but fairly unusual for a case like this to be processed in 6 months for a first H&C with a long stay and a Canadian child unless there is more to this story. The bigger issue is the timing of the JR given the H&C refusal was in October.

As I have mentioned before IRCC got very lax with H&C approvals like every other form of immigration and we are undergoing a large course correction. People need to be prepared that getting approved for H&C and PR in general is going to be much more difficult and will focus on rare exceptions like the original goal of the program.

We did bring up points about inability to access education as my older sister and I are no longer fluent in the language of our home country. Our skills are comparable to that of a 10 year old. We also brought up the fact that my younger sister can’t speak the language and she’s only ever been in Canada. I am currently 17, will be turning 18 this year. My older sister is 20 years old and will be turning 21 this year. Both my parents, and my older sister, were working before they took their work permit away. My family does not take any government support money, except for the time of Covid.
My family moved to Canada in 2015 and we applied for refugee in 2016. We appealed but got refused so we decided to apply for H&C since we’ve established our lives in Canada by then.

the documents are listed on AIP letter, copy of passport, married certificate etc, and around 2 weeks or so you get the medical exam request.
After you send it to them...wait and wait..
I've send it all in August 2... after that....not even a merry Christmas.

pcc police clearance of any country you have lived more then 6 month since u were at age of 18 my be that is why ?

all the dresses and place of work since u been in canada !

if ur application was submitted before 20 months ago u need to file new fourms for updated info

Asides hardship back home do you include other grounds to make your application stronger? If not once you receive the reason for refuser you have to add more stronger grounds and don't wait for one year before reapplying. Send a reconsideration and reapply as well.

Hi guys... anyone has any update on their H&C application these days?
It seems that nothing is moving

No my friend, nothing is moving and it makes me anxious, I called yesterday and was told criminality is in progress and everything else is complete, seems like there is something going on and they are not issuing portal 1 emails, I checked other threads and looks like there are very minimal portal 1 emails I was able to find may be 2-3 people who got portal 1 in January and Feb,

the same here...my process got stuck in background checking and I'm not seeing any email 1 these last months as well, there's something happening there for sure.

Same here, its now 5 months since receipt of AIP but no portal 1 email yet. Its so overwhelming now

Also I added establishments but they don’t consider that much.
