PR Not Meeting RO Sponsor Spouse for PR Application

Hi guys,

I am a PR who haven't met residence obligation in the last 5 years and I am currently in Canada. I plan to stay in Canada for 2 consecutive years to renew my PR card. In the meantime, while I haven't met my residence obligation, I have three questions as below. Thank you for your help in advance!

1) Can I sponsor my wife for her PR application?



2) When IRCC processes her PR application, would they check if the sponsor meets residence obligation? Because my PR card is expired so I guess it will trigger red flag to IRCC.



3) Just wondering what would happen if they found out I haven't met RO?

You were told couple months ago to delay any interactions with IRCC. If you want to take risk of your PR status, then go ahead.

Thank you for your response, Steaky! I understand I was suggested by people here not to interact with IRCC. The reason why I asked this question is that I consulted with a immigration lawyer recently and she mentioned renewing PR and sponsoring spouse for PR are two different application streams. For spouse sponsorship PR application, IRCC doesn't check if sponsor meets RO or not.

I am not sure if she is right so want to ask here if there is someone like me who have successfully sponsored his or her spouse in the past.

You should assume the IRCC checks everything

Why wouldn’t they ?

RO is connected to being a PR. The only reason you’re allowed to sponsor is that you’re a PR

I bolded the part that I think is wrong in your thinking: I don't think the question is whether there have been some who have successfully sponsored in past, but whether there is a risk of it going badly (there is) and how high the risk is (unknowable, but higher for someone who has been out of Canada a lot and only recently returned) and whether that risk is acceptable to you (only you can decide).

Your lawyer is correct that PR card renewal and sponsoring spouse are 'two different things.' I believe she is incorrect in stating that IRCC 'does not' check - they can and sometimes do, although it is not a required part of the process (as it is for PR card renewal). We don't know how much they check or in precisely what circumstances.

Your decision, but of course, if they do check it and your lack of compliance is obvious and significant - you don't have much recourse if they pursue it.

As I recall you only returned a few months ago and have barely been in Canada in the last five years. You will show your work history and other things - which will demonstrably show that you are out of compliance. That seems risky to me.

But it is your choice.
