Hello Experts,

I have a question regarding a visit visa for my family. I am a Permanent Resident (PR) currently residing in Canada but do not yet meet the residency obligation. Instead of applying for spousal and child sponsorship, can my family apply for a visit visa to come to Canada?

Additionally, if they apply for a visit visa, will it trigger a review of my PR status since I still do not meet the residency obligation?

Are they not PRs? Did they renounce PR? Once is Canadian too. They can try but chances of refusal are high because IRCC will know they have no plans to return. They need to show strong ties to return (job, business, income property), their own funds And strong travel history.

Assume they renounced their PR if they want to attempt to secure a TRV.

My family already renounced their PR because I planned to sponsor them. However, based on suggestions from many experts like you, I have not submitted the sponsorship application yet and am waiting for my PR card renewal.

In the meantime, my kids are becoming restless as they wish to visit me during their summer vacation and then return to India to complete their education. One of my kids is currently in 11th standard, and I want him to finish 12th standard in India before coming to Canada for college after a year.

They can try but given that you are PR in Canada and they renounced PR, the chances will be very low that IRCC will believe that they will leave.

They can try but given that you are PR in Canada and they renounced PR, the chances will be very low that IRCC will believe that they will leave.

Sameer - you know the saying....read the room?

I understand how difficult it is to stay away from family - and specially convince kids to continue to stay away.

I'm not a lawyer, you may want to check this out with them though.

But just a common sense approach - this is not the time to visit Canada, specially when red flags can be raised easily on your file. Till things get settle down at IRCC, and the anti-TRV sentiment cools down - id say DONT stir the pot. Dont give them a reason to question your stay. Things that was pretty normal and would pass under the radar 6months - a year ago, has now changed. They will be looking every single application with a big microscope these days.

200 days is less than a year. Till then, keep your head down - get your PR card renewed - and by that time there will be new government and temperature will have cooled off. Then go ahead and bring your family here. And yes -- you can sell this trip to your kid as his prize for finishing 12th grade with good numbers....not sure if you will succeed in that. But you can try (and let us know how it goes :)
