My application for PR was refused today and I am considering what to do next at this point.

ITA: July 5 (Healthcare Draw)
AOR: July 30
BIL: August 21
BIL Completed: August 23
ADR: January 10
ADR Submitted: January 14

Refusal Note -

In your application, you claimed Foreign Healthcare Work Experience work experience at “XXX Health” as a Healthcare Assistant, under 33102 – Nurse aides, orderlies and patient service associates. In support of your claimed work experience at XXX Health, you submitted an employer reference letter, along with a Healthcare training Certificate from said Employer, indicating successful completion of training as a Healthcare Assistant. I requested paystubs/salary deposits, and you provided a Cash Salary Certificate. Other than this 6 months of claimed Healthcare work experience from XXX Health, all of your other employment appears to be in the IT/technology sector. Your bachelor degree is in Mathematics and your Canadian study is in Computing/ Information technology.

Based on insufficient information, along with the documents you provided in support of your claimed worked experience for “XXX Health”, I am not satisfied that you have performed the duties/ work experience claimed. As I am unsatisfied with your claimed work experience at XXX Health, you are no longer eligible for the Healthcare round for which you were invited to apply for.



For an understanding of my situation, I am into IT, studied and worked in IT majorly. I arrived in Canada as an International student, before my arrival as a student, I got advice from a friend to take a healthcare course/training which would allow me to get a job as a PSW during my studies in Canada, as it's difficult to get any role in IT while studying. The idea made sense to me so I got a paid placement (training on the job) in a local health facility in my country and worked for 6 months, I got a training completion certificate from the employer, as well as a reference letter which highlighted what I did, it also mentioned that I was paid in cash, this is not uncommon for local small businesses/facilities in my home country.

This work experience helped me get 2 Healthcare jobs when I landed in Canada during my studies. I still have the employment letter for these jobs, even though I only worked with them for a few months, before deciding to face my studies square-on, also, I noticed during my tax filing of 2022, I got a T4 from one of the PSW work that I did. I didn't mention these work experiences in my application because (1) I am not claiming points for them (they are experience gained while studying) and (2) My main status as of then was a student so I was studying fulltime and working part time. When I got an ADR from IRCC, I reached out to the employer and I was given a Salary Certificate, I added the email correspondence with the employer as well but my application was still refused.

Since the officer claimed I don't have any other healthcare experience apart from the one I claimed from my home country, what are my chances of reconsideration if I submit the employment letters/correspondence/T4 from the healthcare jobs I did in Canada to prove that I have indeed worked as a PSW in other facilities/situations? I am just so tired and confused with this whole issue. Any help/suggestions will be appreciated.

the final decision claims that the visa officer is not satisfied you did have this job, so if you want to apply for reconsideration, try to provide more information to prove you actually had this job. better yet, hire an immigration lawyer.

Yes, the ADR was proof of income for my foreign work experience, in which I submitted the Cash salary certificate. Before then, I already attached reference letter, certificate issued by the employer, and email correspondence with the employer to my application. These are all my documents from this employment, I never knew I'd use the experience btw. I'm not sure if getting an immigration lawyer will help since they'd have to work with the same documents the employer issued.

IMO this is the sort of refusal that you won't be able to change with a reconsideration request. Although you can try.

You'll most likely need to appeal the decision if you want to fight this. Time to hire an immigration lawyer.

Yes, I finished my studies in 2023. I have worked as an IT professional since then. The PSW jobs I did were during the early days of my studies.

Yes, I finished my studies in 2023. I have worked as an IT professional since then. The PSW jobs I did were during the early days of my studies.
Ultimately it's your choice what you do.

You can try a reconsideration request but I don't think IRCC will overturn the decision based on the info you've shared.

You need to decided if you are going to go through the expense of appealing or instead focus on applying for PR through a different stream.

well, i mentioned lawyering up because technically you're eligible for the ita but the situation you are in is not that straightforward. obviously that will cost a lot of money, and energy. wish you all the best!

Have you put in this healthcare experience while applying for your study permit?

Another issue may be that your work abroad as a PSW involved being trained at the same time as you work. Did you receive a certification at the end of “work” period? In general the fact that you are applying for HC stream although you have not studied or worked in HC for quite some time and does not appear that you may ever work in HC again defeats the purpose of the HC stream.

Maybe. The officer's tone suggests that, but if a paid internship is acceptable, I see no reason why that should be an issue. Yes, I received a certificate after I passed probation (3 months). The Healthcare stream doesn't have such requirements though, like I said, I have other experience in Canada as a PSW, but for working later in the future in healthcare, no one knows what the future holds. Thanks for your input.

However, my BOWP was submitted with a restoration of status. At the moment, I am thinking of applying for a Visitor's Visa/Record. Do I need to submit a new restoration of status with the VV/VR application or I can submit the VV/VR application alone since I already have a restoration submitted with the pending BOWP..?

However, my BOWP was submitted with a restoration of status. At the moment, I am thinking of applying for a Visitor's Visa/Record.
