When exactly did your parents fall out of status? Is it over 90 days ago? The date they fell out of status should be in the paperwork they received. An H&C claim does not give you any status in Canada. If there is a removal order you can ask CBSA if they will put the removal on hold until the outcome of the H&C. It is at the discretion of CBSA to determine if they will put the removal on hold or not.
That is what they have attempted to do by using EOI2020 and not creating a new EOI. Technically to qualify for EOI2020 would have meant you had already met LICO since 2018 and have qualified for PGP for at least 5 years at this point. I do expect that if/when they open the pool again there will likely be some sort of prioritization because there will be hundreds of thousands of applications for around 20k spots. Even with prioritization many will still wait a long time to get selected.
There was essentially a pause in eCOPRs because IRCC had met their quota for 2024. Really depends on how many eCOPRs they have already sent out. The fact that we are at the beginning of the year likely means you will receive eCOPR if approved much faster than later on in the year since 10K quota for all H&C programs will get filled relatively quickly and then then eCOPRs will be on hold once again until 2026. Assume reforms to the program are also in the pipeline since current system is not manageable.

Your landing was likely on hold because of quota reasons.Many eCOPRs are being slowly sent out since the start of 2025.
90 days will be end of Feb, I want to file restoration before 90 days and ask them to restore status until HC decision is made. They never violated immigration law and I dont want them to overstay. Mom’s status expired October 2024, received visitor record refusal. So I want to use 90 day rule and try to restore status. I know it will be extremely difficult.
Im just worried that if they leave they might not be able to get another 10 year super visa because they filed HC. So if they leave that would be it… at the same time I dont want them to stay here illegally as Ive put so much effort and $$ to maintain their status past 10 years.
