Background: I am a CAD citizen living in the USA temporarily working here. S/O came as a child to the USA with her mom on a legal visa and they applied for asylum, because of court backlogs they still have a few years waiting for their case to be figured out at the least. She has no passport, and no documentation from her home country. Is there a pathway to bring her to Canada if her situation in the US does not work out? Would her asylum case in the US make her inadmissible to Canada via spouse sponsorship?

You can sponsor her from outside of Canada however she needs to have a valid passport to complete the process. I'm not aware of any work around that would allow her to complete the process without a valid passport. What county is she from?

I assume you are either married or have lived together continuously for at least one full year.

Bangladesh, however she cannot obtain a passport because of her pending asylum case

Just to add, there are other documents she would require for the process, such as her birth certificate. She needs to look into how she can obtain this and the passport from the US. However since she has filed for asylum, not sure if trying to get a passport could negatively impact her claim. This is a discussion she needs to have with her US immigration lawyer.

I just posted a follow up and was wondering if they was the case.

I'm not aware of a work around. Suggest paying for a consultation with a good Canadian immigration lawyer. Do not speak with a consultant. You need a lawyer.
