Preparing to apply for Common Law

We're getting to submit our common law sponsorship application. We have been together for almost 2 years now. We've been living together for 10 months now. We plan to apply on the 13th or 14th month.

✊️Here is what we have:✊️

1. We have rental agreement in ours names.
2. Our current address has bills coming in on both our names.
3. Phone bills have our address.
4. We have bus tickets, hotel booking and flight tickets in our names.
5. We have a letter from our previous landlord confirming that we stayed together.
6. We have a joint bank account.
7. Statement of his investments and pay stubs.
8. We have millions of pictures together at different places.
9. He visited me in my country.


✊️Concerns.✊️

1. His Driver's license, and health card are joined together and it has his parents' address since he drives their car.... For insurance purposes.... We plan to add an explanation letter for this.

2. Utilities at our previous address was in only his name but I have mails, ID card and a letter from the landlord confirming we stayed together.

3. We don't have support letters from both of our families because our "religion and culture" doesn't accept cohabitation.

To do after 12 months ✊️

1. We plan to file for statutory declaration of Common Law.
2. He will put me as a beneficiary on his insurance and CPP after we file the declaration of common law.
3. We plan to create a document for property district, since I have a property and he has investments.... We will have a notary republic endorse it for us.
4. We will get three support letters from our friends... About 3-4 people.

You should be fine with the above. Minor comment, I encourage you to NOT confuse in your minds that 'relationship stuff' and 'common law stuff' may overlap, but they are distinct.

You need to show you lived together 12 months, continuous - that's the common law stuff.

Some of the stuff you have here abvoe is about the relationship. You show that where appropriate.

Do NOT list or submit the things that are concerns unless they are clear gaps. Present the stuff that supports your case, leave out the stuff that doesn't. Only submit with explanations if you feel it's required. (I'd mostly say what you have from above is fine).

Also some of these are overkill. Use your best judgment. Letters from friends are often not necessary unless there's some doubt, for example (in my opinion).

Just to clarify what is important with common law is to prove one year of cohabitation so bills with same address all the way back to beginning of the cohabitation period. If you were not living together and you had different mailing addresses having a previous landlord indicating that your spent time together is not helpful. Proof that you have updated your CRA status to common law and/or file your taxes as common law also helpful piece of evidence.

Just an FYI you are essentially stating your partner is committing fraud by declaring that he is living at another address. If he actually did have an accident insurance companies could deny the claim because he lied about where he was living. In general not a good idea to lie about your address there is a reason your current address is on government documentation.

It's not immigration related but I think he should update his actual address with the province.
Just need to pay a bit more on insurance. (btw my husband just added his worker to his truck's insurance with a diff address and it actually lower the insurance cost... cos he has good driving history.) Using a false address for insurance purpose can result in a denial of claim.
It defeat the purpose of getting insurance.

I don't know if you read my post to understand or just to respond. I don't remember stating anywhere that we're not living together...
It's not immigration related but I think he should update his actual address with the province.

His address has been updated with the province, his residential address is our apartment and mailing address is at his family's. It's just not changed on his ID card.
I mean he needs to update his ID cards as well. For BC, it's a simple process. ICBC will mail a sticker to put on the DL card.
Not exactly sure about other provinces. I didn't recall saying that you didn't live with your common law partner. May be it's another post by some one else?

Thank you... His address has changed already. We will contact the province and get the address change on his ID... Thank you for your input.
