.Hi, my work permit expired on August 22 2024, but I was issued a work permit extension until January 11, 2025. Unfortunately, it was refused today, December 5, and I was informed that my status has expired as of today. The reason for the refusal of my BOWP was stated as a cancellation of my Provincial Nomination. However, when I contacted the province that nominated me, they confirmed that my nomination was not canceled. As a result, I submitted an LMIA-exempt closed work permit application today December 5. May I kindly ask if I am currently on implied status, or do I need to apply for restoration? Thank you very much
1. Your Status Expiration: Since your work permit extension was refused and you were informed that your status expired as of December 5, 2024, you are now considered to have lost your temporary resident status in Canada.
2. Submitting an LMIA-Exempt Closed Work Permit: Unfortunately, submitting a new work permit application after losing status does not place you on implied status. You are required to restore your status before your new work permit application can be processed.
3. Restoration of Status:
• You must apply for restoration of status within 90 days of losing your status (in your case, by March 4, 2025)
• When applying for restoration, you should explain the situation (e.g., the refusal of your BOWP and confirmation from the province that your nomination was not canceled).
• Restoration must be submitted along with your LMIA-exempt work permit application if not already done.
4. Next Steps:
• Ensure you submit a restoration of status application immediately if you have not done so yet.
• You can submit a single application for both restoration and a new work permit using the appropriate online process.
5. Key Notes:
• While awaiting the outcome of your restoration and work permit application, you cannot work or study in Canada.
• Be prepared to provide proof that your Provincial Nomination is still valid, as this might be critical to resolving the confusion around your BOWP refusal.
