I assume your father has an H&C application in progress. Does he have AIP yet?Hello everyone! Please I need urgent help from all of you who can answer my question. My dad's visitor record application was refused and they said the following: You must leave Canada on or before the expiry of your current document or, if your document has already expired you must leave Canada immediately. Failure to do so could result in enforcement action being taken against you. My dad's status already expired mid September, 2024 so he was on implied status. How long does he have to leave Canada? Does it mean he has to leave tomorrow? he has been maintaining his legal status for 10 years exiting/entering/extending status. I dont want him to be illegally here as Ive done everything for him to maintain status. Please help what should I do?
Sorry to hear that, try reaching out to your H and C lawyer, they should be able to assist you with this, also from this link I found that your father is eligible for restoration,Hello everyone! I am on your boat kate, dont worry he has the restoration option, and if the restoration is accepted he should be able stay in canada until a decision is made on his H and C application, you have 90 days to apply for restoration from the date of the visitor extension refusal, and yeah what the govt is doing is pure injustice against its tax payer citizens,I have developed severe anxiety disorder just by thinking that my mother will have to live just by herself without any social support if she is forced to leave canada but the govt doesnt seem to care, filed H and C application 16 months ago and no response from them,so yeah you are not on this alone, feel free to dm me if you need any assistance, would be happy to help@ibrahim0175 and @scylla thank you so much for prompt replies. You dont know how much I appreciate. Im beyond greatful.
Here's the situation: My parents were granted Super Visas sometime in 2013, theyve been maintaining their status for 10+ years, exiting Canada and re-entering or applying for inland extensions. We tried PGP and no luck, then my situation has changed significantly that I had no choice but to apply for HC relying on best interest of child and family reunification, in less than 6 months 1st HC was refused, then reconsideration was filed and they refused to open the case. I filed second HC which is pending 17 months. My mother's inland extension was approved for 6 months, my father's inlad extension was refused with the above note. It does not say anything about restoration of status. I dont know what to do. I dont want my dad to stay here illegally after maintaining status for 10 years. Does anyone know what people do in my situations? what happens after 10 year super visas expire? Government does not say anything about this... all they say is that PGP is not available and as alternative you can use Super Visa, but they say nothing about what happens after 10 year super visas expire... Super visa allows parents to stay 5-7 years in Canada. But what happens after? They should apply for another 10 years? or they can never visit me here? When visa officer sees that you lived in country for 7 years and lost all ties back home (parents, siblings etc) they will not approve another 10 years. I dont know what to do and government does not tell us what to do in these situations after 10 years of super visa are expired.... ((((
The processing time is approximately 20 months. It's the same for all applications. Sometimes applications are processed faster however best to assume processing will take around two years for your application. You can apply for a work permit once you have AIP. Generally speaking, it takes over a year to receive AIP after your application has been submitted.Hello! I recently submitted my h&c profile for the medical treatment of my kid. Can someone guide me on the processing time? Is it same in all cases or medical cases are taken separately? And is there anything i can do to get a temporary visa other than visit visa to be able to work here while i wait on the decision on Pr.
Thank you
I would apply for restoration.@ibrahim0175 and @scylla thank you so much for prompt replies. You dont know how much I appreciate. Im beyond greatful.
