Hello Everyone,

I am seeking some clarity and advice regarding spousal sponsorship under special circumstances. I have a pending charge of criminal harassment, with the trial scheduled for March 2025. Despite this, I am getting married next week in Pakistan.

Given our situation, I am uncertain whether to start the spousal sponsorship application process now or wait until after the trial. My fiancée and I have been engaged for over two years, and the lengthy sponsorship process will undoubtedly impact our family at various levels.

I would greatly appreciate any opinions or suggestions on navigating this particular scenario.

To the best of my knowledge IRCC will put your application on hold and won't process it until the outcomes of your trial are known. So you can submit the application now but processing will be halted until after your trial.

Nothing to add, Scylla is correct.
How would they know if the outcome of the trial is decided. Do I need to let them know? Or is it an automated system?

During that time will I get a UCI number? And will I be able to call my then wife to Canada for visit visa? Or will that be affected too?

I don't know how they find out. I presume they get a notification OR can check themselves periodically. When/if you get a judgment clearing you, you can send a copy or notice to IRCC.

I don't know about UCI#. Your spouse can certainly apply for a visitor's visa, no-one can tell you if it will be approved. It may not benefit from the consideration given for spouses with sponsorship apps in process - at least that would be logical - but I do not know for certain.

Hi,

There's a thing, or there was when I was aware of such things, called a "Court Desk" in CBSA offices.

A clerk gets the daily court logs for their region and looks through the rolls of tombstone data: name, dob to see if there isn't any non-citizens in conflict with Canada's Criminal Code. They build a knowledge of the cases as they follow their progress through the courts.

It's a business line for the CBSA where criminal statistics are pursued to support budget requests, and they make good press.

Your wife can attempt to get a TRV but unclear if she will qualify for an SOWP. What if you are found guilty? What if she can’t get SOWP and is not able to extend her visitor status?

Thanks for the response; I am not worried about the outcomes at my end. I am very optimistic about being free from charges. I am just looking forward to focusing on the process for my fiance's sponsorship and when and how to proceed with it.
