Need to sponser my wife who is on workpermit (ending in april)

Hi Im canadian citizen and indian origin.. me and my partner got married on aug 3 2024 in Toronto ontario
She is on post grad workpermit until April 2025

Relationship - we are in relation since apr 2023

Do we have to go back to India and get , married there as well in order to sponsor her as spouse in Canada?


she also finished her college diploma (related to dental ) here - 2years and 2.5 year of full time work experience as administrator in clinic
whats are the options here?

No as long as you have proof of your wedding and hopefully proof of at least a small reception you should be fine. Did any of your family especially parents attend the wedding? Assume you have proof of being in a relationship since 2023. Did you live together before getting married?

Yes I do have ceremony pics and videos - it was court marriage at Toronto city hall . only my friends attended - none of parents

Did you have a reception afterwards even if small and less informal? Did you live forever before marriage and if so for how long? Have you announced to your family and friends that you are married on social media & posted pictures? Because of the expiry date of her WP always a better idea to have more proof. Also IRCC knows many couples have a court wedding to start the sponsorship process but have their real wedding at a later date. Many do not publicize to friends and family that they are already married which is why I would make sure it is on your social media if not already posted.

No we did not do any reception . she is being living with me 6months. No social media posts we like to keep it private but family and friends know. that's all pretty much the case .

If you have evidence of living together (utilities, lease, etc) and can include some photos of group things with friends and/or family plus possibly a letter or two (family would help more, friends still a positive) then the application would be stronger. Much stronger if the living together evidence is solid.

I see yes thats wht i was thinking but she used to live on different address (renting her own until like august ) all bills at my address are under my name only . pics I have all since last April 2023 going out getting together and stuff

Since you've not yet applied:
-you should be able to demonstrate that she has no other address anymore (her updated bills and things).
-Look for what you can that would show she's been living with you six months - helps.
-Failing that, take the time now to ADD her to bills and other docs with new address (changing her IDs and etc now)
-See the other things that show you have merged your lives and accounts etc. (In modern world this doesnt' mean you have to merge all accounts immediately but a joint account or two wouldn't hurt). Insurance, spousal stuff, etc.
-If either/both of you are changing your family name, change at least one or a few of those docs now so as to support further.

None of this should take that long to pull together.

In this case, the perfect is the enemy of the good, though - it doesn't have to be perfect/complete (eg all bills changed to joint names), just get some to show the process is underway.

Not acknowledging your marriage publicly is a huge warning sign for IRCC. They do look at things like social media. Court wedding with no parents/family and no strong proof of living together longterm is quite unusual for people of Indian descent especially in relatively recent arrival from India. If you are applying for spousal sponsorship you should also be prepared to be openly posting about the fact you are married. The one caveat is if it would put your life at risk but that doesn’t seem to be the case in this situation based on the limited information you provided.
