PR supported LMIA

Hi All,

I just want to know that currently I have open PGWP. Now I want PR supported LMIA from same employer with whom I did my 1 year NOC B experience, to claim additional 50 points under express entry.

Should it make my work permit closed or still it will be remain open PGWP.

Usually, once the LMIA is approved, employers want the beneficiary to move to a closed WP. I see no harm in moving to a closed WP unless you don't trust your employer. The other bigger question is how long your PGWP is valid, also if you are confident that the PGWP will outlast COPR. If PGWP expires in a few months, it is better to move to the closed WP.

Thank you for your response. My PGWP will be expired on November 2025. So, I want to clarify it’s not mandatory to make PGWP closed. It’s depend upon my Open PGWP remaining time?

Your employer has a limited time window from the approval date to get a closed WP (it is reduced now to 6 months earlier when it was 12 M). Hence employers would push for you to move immediately. No law says you must be on a closed WP for the PR. However, it would sound better and neat on the application if you are on a closed WP. If you are on a closed WP you might not receive an inquiry from the PR case processing officer or chances of the PR processing being delayed by the case IRCC analyst, who might put a comment saying the applicant is on an open WP and claims 50 points, thus the case might wait a longer time for the officer to take a decision.

As I said earlier, unless you deeply mistrust your employer, moving to a closed WP is a better choice.

I learned that you can claim the 50 points only for the 6 Months the LMIA is valid, Assuming after ITA if your application processing duration goes beyond that 6 months from the LMIA approval date IRCC might reject your application.

It is not compulsory however as mentioned earlier your ITA, application submission, and finally, your application processing duration might be beyond that 6 months from the LMIA approval date. Since you will live with the scare that IRCC might reject your application.

Overall the best bet is to apply for a closed WP
