Restoration of Work permit..please help

Hi all, posting this on behalf of my sister.

Hi everyone, I received my Ontario nomination through master's stream and will apply for non express entry PR by the end of this week. My PGWP expired on 25th April 2024 and I received my nomination just a day before. I have a visitor's visa and it expires in 11/2027. I just discovered that I won't be eligible to apply for bridging work pemit after I receive AOR because I don't have valid work permit. I will apply for restoration of work permit as it hasn't been 90 days since it expired. I want to apply for federal PR and then restoration and then try and see if I can flagpole at Canadian border at Rainbow bridge. Can I restore my status as worker by doing this? I can't wait for a year to get my PR and then work. Please suggest something, I'm not finding any solution to this. Thank you

It's a bad idea to flagpole while out of status. You should only flagpole with valid status in Canada.

Would someone be able to help me with my case? I started my MBA at one school on the last day of my first term. I got a job, transferred to another school, and got the enrollment letter, too. I thought it was a break and continued working till my new school started; the gap is around 1.5 months...

You should reach out to an immigration consultant by phone, mail or in person. Many of them can advise you right for free. Try not to wait on this..

She has a visitor visa of 10 years multiple entry that's still valid. Does that not qualify as valid status?

No. She is out of status in Canada.

Her permit expired on April 25 so she has been out of status since then. Having a visitor visa allows entry but doesn’t maintain status.

The visitor visa validity only indicates how long she is allowed to use it to enter Canada. It does not give her status in Canada. She is out of status. She shoud not flagpole while out of status. This is risky.

It's not a valid status. You need a visiter record, work permit, study permit, etc, for that.

Thank you for the reply. She is applying to non express entry PR today with the OINP nomination and will be applying for restoration of work permit based on that. Will that be okay?

She cannot apply to restore status to worker until she has AOR for her PR application through IRCC. Her OINP stream is not a job offer stream.

Okay. Because we found out that she cannot apply for restoration after 90 days and AOR will not be before that. Also, we read somewhere that she cannot apply for restoration when on visitor visa. It's all very confusing.

Most likely she is waiting until she has PR to work in Canada again. She will not be able to restore status unless she gets AOR from IRCC within 90 days which is unlikely. She has no status right now so need to change status to visitor.
