URGENT HELP! Delayed processing of TRV application from inside Canada for wedding and honeymoon

I am writing to seek guidance and assistance regarding the processing of my Temporary Resident Visa (TRV) application from inside Canada.

I am work permit holder and submitted my TRV application 3 months ago, but unfortunately, I have encountered significant delays in the processing of my application. Despite providing all required documents and completing the necessary biometrics on Dec 2023, I have yet to receive any updates on the status of my application.

This delay has left me feeling extremely stressful especially considering my upcoming wedding and honeymoon plans scheduled for April to June this year. We worked diligently to make this happen and now we are so worried...

I have taken steps to address this situation, including filing an Application for Leave and Judicial Review to seek reasons for the delay and pursuing a writ of mandamus to expedite the processing of my application. I received the response of "No reason" recently and I do not know what to do next, and do not know how to reach the VO who signed the letter of mandamus.

With the help of local MP and application status, my criminality has passed but eligibility review is never initiated.

If anyone in the community has experience or expertise about my situation, I would greatly appreciate any insights or advice you can offer!

You are experiencing normal processing times so some of these applications should not result in getting the TRV. Would ask your MP to see if your application can be processed on an urgent basis but a wedding a travel plans are not typically considered for urgent processing like a medical event for example. The other option may be to contact the media and if they are willing to publicize your situation you may get faster processing time. Although this must be very distressing there is not a lot you can do because your processing time is comparable to others applying. When exactly did you apply in December? The holidays mean that there is little processing for around 2 weeks in December/early January which has to be considered when looking at your processing time. What is your status in Canada and when does that expire?

I am grateful for you comment.

I submitted my application in November 16. Biometrics completed on December 16.

I did contacted local, they said as legal action has been taken on my file, the application automatically became non-routine, and the estimated processing time would not apply to my application. The current status of my application is eligibility review is not initiated, and criminality is passed.

I have been studying and working in Canada since 2015, and I am a post-graduate work permit holder, which is set to expire in late 2025.

The wait is completely normal. You can't just demand for an expedite process whereas there are a lot of more people waiting. Filing for Application of Leave and JR only made your application non-routine and on top of that it just makes you look entitled and whiny, so I am not sure how is that going to work in your favor.
Entering Canada is a privilege not a right.

As the average processing time for TRV from inside Canada is 15 days, and I applied 5 months before my wedding trip and I thought it was sufficient. Hence, after two and a half month seeing eligibility review is not even initiated, I thought I have to take actions actively to get my application processed on time.

As a law abiding resident of Canada for the past 9 years (undergrate and graduate study and work... study hard and work hard), I don't know why this happens to me...

I am too frustrated and never experienced situation like this.

Posted processing times are just average estimates not guaranteed processing times and posted processing are often not very accurate. Covid has also had an impact on posted processing times because the posted numbers are based on previous data and processing times changed often dramatically during Covid. It’s unfortunate that you hadn’t looked to see how long others were waiting for their TRV to be processed in real life.

Thankss for the info. This issue and self-doubting consumes my energy and spirit... What do you think I can do at the moment?

Update 2024-3-15

For anyone who has similar situation:
After consulting with the lawyer,
1. I will continue to proceed with the next step of perfecting my applicants record of explaining the situation to the officer in the memorandum.
2. If I could not receive any results when I am outside Canada. I will need to withdraw my current application and apply again with clear letter of explanation of my previously withdrawn TRV application.

There is not garantee of anything..... Will see......

The TRV is approved at the end of March, before I submit my step 2 application record. Had also withdrawn my application for leave.

Again, for anyone who has similar situation. I would suggest to approach in the following sequence:
1. Contact Call Centre to issue a note to officer & Request for ATIP
2. Contact local MP
3. Consult Lawyer
4. Considering application for leave
