Hello friends,

I am a Canadian Citizen and became a PR in 2017 through the Federal Skilled category. I got married in June this year and am planning to sponsor my wife. However, got doubt whether our marriage would last or not. So if I sponsor her....

1) How long will I have to wait to sponsor a new wife if I get divorced from my wife?
2) There is a three-year liability if I bring my wife. But I can't find anywhere how much money I have to give her every month for the remaining three years if we get divorced.

You won't be able to sponsor anyone else until the 3-year financial responsibility period has passed.

There is no immigration law saying you have to pay her anything. But, if she receives any kind of social assistance benefits in the 3-year period, you will have to pay back.

Consider we get divorced in the 3rd month of her coming here. Now, for the next 33 months, I won't pay her anything, so she goes to court and asks for financial support from me. Then what will the judge rule for me to pay her?

That is immigration fraud! If you know the relationship will end withing a short period!

Any government assistance she gets for housing, living expenses etc... during the 3-year undertaking you have to pay back. You can't file for a new sponsorship if the previous person you sponsored collected assistance, and you have not paid the government back. And legally she can sit on her arse and not work, and you are responsible. If she was to seek spousal support, during the divorce she would get it, especially if unemployed. Even if she has a job but can't afford rent or food, you will be ordered to pay.

No. Three years is correct. You are confusing two different rules. The OP is the sponsor so the 3 year rule applies. If the OP was being sponsor and then wanted to sponsor a new spouse later, the 5 year rule would apply.

Keep in mind, social assistance is only one aspect of financial support. The divorce court can also order you to pay support directly, based on Canadian law. And that can be expensive. Think twice before you sponsor if you don't think it will last.

Depends on your income or income-earning capacity and her income and capacity, the duration of the marriage and any pre-marital cohabitation period, as well as some other factors. You can probably find the federal Spousal Support Advisory Guidelines online to get some idea.

Absolutely! I had to pay support for my ex-wife and she isn't even PR as I cancelled the application. Let's say it's very expensive.

If you think you will get divorced, forget about sponsoring her at all and wait out. Otherwise, it will bite your ass in the end.

That's brutal. The relationship with my wife is not going well but there is a huge family pressure from both our ends. Some relatives are involved who are extremely upset as I am not sponsoring her. Otherwise, I would not have thought at all.

if the relationship is not going well, adding sponsorship to your basket is not a good move.

Figure out your marriage first. If you think it will work out, then consider sponsoring her. It's not a light decision. The undertaking and spouse support can add up.

Would add that if you sponsor your spouse and you separate soon after you will face a lot of scrutiny if you attempt to sponsor someone else in the future especially 3 years later. You have to imagine how this looks as an IRCC agent. Assume this may have been an arranged marriage and you likely haven’t lived together or dated in person for long periods of time. If you went to India to get married and then sponsored your new spouse from Canada and separated soon after her arrival in Canada there will be concern that this may be immigration fraud and this was never a true relationship just marriage for sponsorship purposes. It actually appears that it is actually what is happening although the relationship has broken down you are being pressured to go through with the sponsorship. Although there is family pressure isn’t your family concerned that your life will be put on hold for 3+ years if you want to sponsor another spouse? What about the expense of potential spousal support or potential repayment of welfare payments?
