Husband sponsored wife for PR but want to withdraw application

Hi All,

We had submitted our PR application in feb 2023 and right now we are heading towards divorce. He already has a PR from past one year. My medical result is pending as he has sponsored me .

Also, the matter of fact is we lived together only for 2 months after wedding and he moved to Canada.so never lived together after the marriage. It has been more than 7 months since we are in this long-distance situation. We both are Indian-origin.

We have mutually decided to get separated as we were facing difference from initial days, tried our best and i am/was not keen to come to Canada now.

1) can he remove my spousal application, without getting any trouble for his PR status ? what is the procedure ?
2) as i have just appeared for medical, and if he withdraws my application, how much time he can sponsor his new spouse ? ( he didn't have to wait for 5 years period as i dont get PR and my file is removed before that).
3) in future after divorce, can i apply own my own (via express entry, PNP) for PR, without any problem ?
2) if i get my PPR request, and i wont send the passport. will it be fine as i don't want to move forward in these scenarios. and want to be separated.

1) He can withdraw the application. I think this can be done vai webform. Don't know the exact steps
2) Once the application withdraw is accepted, he can apply to sponsor his new spouse. BUT since his long distance marriage with you didn't workout, he should spend more time with his new spouse before he applies this time. (or spend more time before getting married)
3) You can apply on your own. Make sure you have the marriage and divorce certificate (any offical doucment for divorce being finallized)

The sponsor can withdraw it either via webform or by phone (I did it myself by phone and it was quick for my previous spouse).

The rest, @YVR123 answered and I agree with them. PR will be officialized only when you land in Canada so if you don't land with that COPR, it will be deemed as incomplete and eventually canceled when COPR expires. This is if your ex-husband didn't withdraw it.

If you are no longer in a relationship you HAVE to notify IRCC it isn’t an option. Without your a divorce agreement you may not be able to withdraw your name and may have to list yourself as non-accompanying. Any subsequent marriages will come with more scrutiny although certainly better if the first spouse never landed as a PR. If you qualify as an economic immigrant on your own there is less scrutiny than being included on a PR application as a spouse or being sponsored as a spouse.

Now he is saying that he will withdraw the file. As i came to know that Without a divorce agreement he may not be able to withdraw my name.
My queries are :
1)meanwhile can i apply for PR application via Express entry(my score is 460) ? will it be any trouble if i put status married and cant mention he has PR.
2)can i apply for study visa or tourist visa or via express entry ? which is the best option.(as i am 29 years old... have to apply urgently)
3)if i apply by any other category will my biometric and medicals be valid ?
4)what should be my marital status while applying ?

If he is sponsoring you (as he's already a PR), he can withdraw the sponsorship application without separation or divorce. I don't understand what you mean by "withdraw my name".

Your other questions are NOT related to family sponsorship. So post them at the EE section.

If you are still married you must indicate that you are married and list at your husband’s information although I would include in a letter that the you are no longer in a relationship and are in the process of getting divorced. Without declaring that you are already separated you don’t have a history of being separated if either of you start a new relationship relatively soon. It will be much better if you applied after getting divorced. Having a spouse in Canada creates ties to Canada which can make getting a temporary visa more difficult. Shouldn’t have an impact on applying for PR via express entry.

He can cancel the application at any time as the sponsor. No divorce agreement is needed. He can cancel for any reason.

1) You can submit an Express Entry profile provided you meet the minimum requirements. A score of 460 is too low to be selected so you'll need to increase your score or look at PNP programs if you want to be selected. Having a Canadian PR spouse will not impact the process.
2) Are you inside of Canada or outside of Canada?
3) Biometrics should still be valid however medicals may not be.
4) If you are separated and no longer living together, then separated. Otherwise married.

I personally withdrew application in 2021 of my ex wife. We were not getting a long but our divorced was not finalized and I was not comfortable so I simply sent email to the visa office asking to withdraw my sponsorship application and in return they asked to write the same request on a paper, sign and send them the scanned copy and I did not have to show no reason of withdrawal neither they asked me to provide them the reason.
It neither impacts the sponsor nor the PA. You should be good to go
