Parents PR Card Expired and not meeting RO

Hi,
My parents got their PR in mid 2018 and did their landing and spent sometime in canada. They intended to settle in Canada and returned to their home country to settle things with the intent to finally move over 2-3 years. They came to Canada in 2019 for a short while again but since Covid in 2020 did not come to canada.

In the meanwhile their PR expired now in mid 2023. They are elderly and has been concerned about travel during the pandemic. In this situation what are their options of traveling back to canada?
1.Are they eligible for PRTD? Does one need to meet RO to get a PRTD?
2. They have a valid US visa and will visit my brother in the US shortly. Can they come to canada with private car over land border using landing document?

1. They need to meet RO for a PRTD but could submit H&C reasons if they believe they have them.
2. They could cross at land border and hope not to be reported. Stay until they are compliant and then apply for PR card.

I'd add - are your parents really ready to reside full time in Canada? With being out of compliance it may not be easy to travel out frequently or longer periods without risking status again.

Might be worth considering super visa instead. But I'm not an expert.

Yes this is a concern.

to apply for a supervisa, do they need to first apply to revoke PR or will it automatically happen if they apply for a visa

They'd have to apply to renounce. I know in some cases for eg trv a pr holder who applies may be given the renunciation form.

But at any rate you'd need to keep in mind some extra time to renounce.

My guess is would make more sense to renounce first but a guess.

2 big issues. They could be reported at the US border. The other big issue as that many provincial health plans require a valid PR card. Given that they have not met the residency requirement to qualify for healthcare and may have never qualified for a health card given their limited amount of time in Canada they could end up without a valid healthcare for around 2.5 years depending on the province since they must reapply for a new health card if they enter Canada and plan on meeting the residency requirement needed to qualify for healthcare.

If you can get a B2 visa, you can certainly try re-entering Canada through a land border using a private vehicle and hope you are not reported for failing to meet RO. If you are not reported, then you can enter Canada and then will need to remain without leaving until you meet the residency obligation and can apply for a new PR card. If you are reported, you will still be allowed back into Canada but will need to go through an appeal process to try to keep your PR status.

The first step is to get the B2 visa. Wait times for interviews are quite long in many places right now.

I got the Dates for the August 2023 but already got rejected once in jan 2023. last time she asked what u did in canada.. what to answer for this question in the us interview ..

I would recommend answering all questions honestly.

The US embassy is evaluating for visitors to the US. If you essentially say that you have no intention of visiting the US just landing there and going to the Canadian border tight away that isn’t really a reason to grant a visa for US which is why I assume you were denied already.

We cannot help "frame" an answer that's not genuine.
May be plan a real trip to the US. Then you can apply and get the US visitor visa for real.
