Hi, I've been desperately searching for discussions related to this kind of situation since I am in a similar position. My wife is currently in the U.S. on an H1B visa, while I am here in Toronto, Canada, on a Post-Graduation Work Permit (PGWP) and I recently got my B2 US tourist visa last October (I filed it last year September 2022). We've been contemplating our options, and we've decided not to pursue permanent residency (PR) in Canada any longer. Instead, we're looking into applying for an H4 visa in the U.S. to facilitate my move there. As part of our plan, my wife's employer is currently in the process of sponsoring her for a Green Card (GC). During this period, I'm making the most of my time in Canada by working under my PGWP.
I've come across an article that mentions, "If you are outside the U.S., you will need to submit your application for an H4 Visa at the U.S. Embassy where your spouse or parent has applied or in your home country if you and your spouse are of different nationalities."
Given this information, I'm uncertain whether I can apply for the H4 visa here in Toronto or if I'll need to return to my home country.
I'm truly in a tight spot and seeking clarity on the best way to navigate this situation. If you have any advice, insights, or guidance to offer, I would really appreciate it.
