Do they actually assess the application.

We a family of 3, Me, My Wife, My Son who is studying in the Senior Secondary had applied for a Visitor Visa. It was refused based on 179b of refugee protection act. Stating that
Your assets and financial situation are insufficient to support the stated purpose of travel for yourself (and any accompanying family member(s), if applicable).
• You do not have significant family ties outside Canada.
• The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.

We own a residential property jointly in the name of me and my wife currently valued at 4.25 Cr INR and a commercial property valued at 1.00 Cr INR and more that sufficient fund required in our bank accounts. Also we attached the NOC from my son's school for the travel the travel dates were well within the stipulated summer break, The Business registrations, ITR, Property Documents, Marriage Certificate.

My son being a student in the final year of his school has all the valid reason to come back in order to finish his school. Yet the Visa officer decides he will not Leave Canada. I mean seriously is this a plausible reason to furnish?

We both have running businesses and a travel history as well. I have been travelling extensively for almost 2 decades to South East Asia and Europe. My wife and son have also travelled to South East Asia, Uk and other places. Infact she recently visited the UK and did leave UK after 10 days and got back to India.

I have a dependent brother and a married sister who stays in Delhi. My wife has her parents who stay in Delhi NCR, a Married Sister stays in Delhi NCR. Interestingly my wife's Parents and her Sister's Family whose Son (Our Nephew) who is in BC they all got their Visas and ours was refused. Do not understand what other family ties one can have or show besides these. My Son whose parents we are we too stay in Delhi NCR.

The purpose of stay as stated was tourism and since our nephew stays in BC and works with PWC we were to visit him too during our visit. The relationship proof was also attached along with other required documents. . The purpose of visit was explained as well.

Taking all of the above details as mentioned above into consideration I strongly feel the applications are not looked at in a proper manner neither the decisions that are made competent enough.

Getting a Canadian TRV is difficult. Applying as a family has challenges because then you have no family ties in India.

- Funds: How long was visit and how much in cash did you show? So you were just going to BC? Property and business accounts are not relevant. IRCC wants to see cash in your accounts.
- Family ties: Family is you, your spouse and children under 22. Having parents/brothers over 22 are not considered ties to India.

My son who is studying in Class 12th has to come back to finish his schooling next year :) The School's Noc was enclosed. I am sure no person with a sane mind would leave his schooling mid way :)
Visit was for mere 10 Days and yes only to BC.
Certified Cash shown in bank accounts was in an excess of 70kCAD. Think is way more than needed for a round the world trip for 15 Days.

You can ask for reconsideration through webform if you feel there was an error in law. There are no timelines for reconsideration. May not get a response for months.

Yes I am aware of the fact, will not get any replies for months. Thus Canada from now on is a no go Country :) It's never about the law being erroneous, it's the people who implement it, they need to be competent and judicious in deciding an application based on it's merits.

P.S I have travelled around for almost two decades now and the detailed history was provided too :)

So sorry. Canada is one of the most difficult countries to get an approved TRV.

Yes sir, they have stopped using their brains and just processing the applications with a yes or no randomly..I believe that too without even looking into the case....as a result of which sometimes people are getting refusals and then the PPR....Similar thing happens to my mother's application got refused 2nd time.

Well all humans be it normal or with special needs are blessed with brain by the almighty, albeit in different IQ levels :) I have a person at home with special needs with a certified IQ level of 60-65%. We reason out with him based on his IQ level, Trust me all of that is understood by him is implemented to the best of his knowledge and never goes wrong.

Out here am sure people assessing must be having a well developed brain for sure :) Despite that if they refuse an application stating

Your assets and financial situation are insufficient to support the stated purpose of travel for yourself (and any accompanying family member(s), if applicable).

With a cash flow of 70k CAD :) and Immoveable assets about 5 times of this :) They certainly need an IQ test and certifications :)

Understandable it's their Country and decision as to who gets in and who does not :) fair enough. At least give proper prudent reasoning than refusing an application at Random stating the same 179b to almost each and every refusal for a TRV :)

Your son should apply on his own and should have no problem getting a TRV if he is continuing his studies in Canada after attending g grade 11. The major issue is there are concerns that the whole family or at least one parent will remain in Canada. Would only apply for one parent if you want to try and accompany your son to Canada.
