I recently received a letter from the visa office after passing the eligibility stage. The letter stated, "Specifically, I am not satisfied that you declared all visa refusals to all other countries, including the USA in the stat questions on your application. I would like to give you an opportunity to respond to these concerns. Your response and any relevant documents must be received in our office within 15 days from the date of this letter. If you fail to comply with this requirement, a decision concerning your application will be made based upon the information already submitted with this application."

I made an honest mistake while answering the question, "Have you ever been refused a visa or permit, denied entry to, or ordered to leave any country or territory?" I answered "No" because I thought it was only referring to Canada, as it is a Canadian visa application. However, I have been refusedentry to the USA three times in the past and I mistakenly thought the question only pertained to Canadian visa history.

What should I do?

Respond to the letter within 15 days stating that you have 3 US refusals and list the date of refusals. Fortunately you didn’t get a 5 year ban in the letter.

They did mention

Please note that if it is found that you have engaged in misrepresentation in submitting your application, you may be found to be inadmissible under section 40(1)(a) of the Immigration and Refugee Protection Act. A finding of such inadmissibility would render you inadmissible to Canada for a period of five years according to section 40(2)(a) and according to section 40(3), you would not be eligible to apply for permanent resident status during the period of inadmissibility:

So you have received notice that if you don’t respond if 15 days and submit previous refusals, you may be found inadmissable to Canada for 5 years. You must respond ASAP and if not comfortable, get an immigration lawyer to help with your response. You have misrepresented yourself for by responding you acknowledge the refusals so you may be given a ban or not.

Do you think they will forgive if I write its an honest mistake and they will approve it?

You will not know until IRCC makes a decision. There are no timelines so it can be weeks or many months. Even if they do not give you a ban, it doesn’t mean your TRV will be approved. Focus on responding and not getting a ban. It clearly states for Canada and any other country so you need to be honest and declare any refusals to any country.

I applied visitor visa with my wife and a son on 14th april 2023. I had student visa in back 2010 but unfortunately i came back in the same year spending 69 days there (No Overstay proper withdraw from college and returned back then never get back to canada. In 2016, i again applied student visa but rejected in dec 2016. Now almost 6 years passed. Vast change in my circumtances. From 2017 i am doing business ..I had a BE in Engineering from 2004 to 2009. Now I had Masters degree in business from 2018 to 2020. Married in 2018. went to schengen countries with wife ..i got b1 b2 US visa in 2019 traveled and cam back in 18 days. wife and son recently got US visa valid for 2027 but not travel yet. I have also Valid Visa for Uk 2 year. recently came back from UK for 10 days. My travel history is vast. I have refused US visa 2twice in 2012 and 2015 but someone assist me in 2016 app and not mention US refusals. got rejected but not on the bases of misrepresenting even in Gcms notes wrote Misreprent: NO.
My question is now i disclose all the facts because now i am well aware of everything ..this time i wrote refusel of US Canada and australia 2022. MY question is can they doubt why not disclose in 2016 ? I did the right thing now? and what are my chances of getting visa this time
Your response will highly be appreciated
So did you declare all refusals? Can’t tell you chances for you and your family. You all need to show ties to home country, funds, travel history and reasons to travel. If your wife and son have US visa then a good chance for approval.

i have one question as well
i had biometric in 2016. Then right below to that question these was another question (do you again want give biometric if you travel document have validity i select yes. Because my Passport valid up to 2028 and last biometric valid for 2026. Then in last they ask to pay applications fee and biometric fee(170$) its means for two for my wife and for me. But quantity showing only one. Yesterday i receive biometric letter for my wife but not for me. In my application status they automatically detect my last biometric which is valid for 2026. so i am quite confused they detect fee but not give me any letter and also they automatically upload my last biometric.

My question is they will send me a letter later or refund my fee? or consider the previous biometric? If they consider my previous one then why there is question DO YOU WANT TO GIVE BIOMETRIC AGAIN IF TRAVEL DOCUMENT VALIDITY BEYOND THE LAST BIOMETRIC.
Can’t help you about biometrics.

Okay Thank you for your assistance but dont get proper answer from you for my self satisfaction. I did not put in 2016 now i declare! is this conflict would harm?
So did you or did you not declare your 2016 refusal? If you did not then yes it is a problem. IRCC can issue you a 5 year ban for misrepresentation.

No No i am not saying that ..Recent application i declare all inlcuding 2016 Canda refusal as well. but in back 2016 application did not wrote US refusal back in 2012 and 2015.. application was refused but not indicating misrepresent. Now i thought have to write all so i did. But confused is this would be problem or they think why i did not put in 2016 application.?
If you declared all past refusal for all countries then that is all you can do. You have done the right thing.
