PR application refusal, need advice

In 2017, I filled out a CIC profile, where I mentioned that I had been working as an IT Analyst for 10 years in a company, even though I was working in the digital marketing field.

This was because I intended to apply for Nova Scotia PNP, which at that time included IT Analysts in their Occupation in Demand list (they don't have marketing).

However, before I could apply for that job code, Nova Scotia removed it from their Occupation demand list.

However, I didn't submit my CIC profile at that time.

Due to this change, I decided to apply for SINP, but unfortunately, they also did not have that job code in their Occupation demand list.

Instead, they had a job code that was relevant to marketing.

Therefore, I created another CIC profile after one year that mentioned that I had been working as a Marketing Manager in the same company for the same tenure of 10 years.

In January 2018, I was able to apply for SINP and had submitted the fees as well. However, I did not receive any update from SINP for a long time.

In 2020, after almost 2.5 years, I received an email from them about the cancellation of my application due to misrepresentations of Job Experience. They asked for an explanation within 10 days.

Unfortunately, I was unable to submit my explanation to them within the given 10 days due to the COVID lockdown.

Now, I am interested in applying for Canada PR again and would like to know if it is possible for me to apply. Moreover, do CIC or the Provincial Nominee Program check older CIC profiles?

Did you get a ban for misrepresentation from SINP? What did the email state? And yes, profiles are kept on file.

Here is the first email that I got from SINP asking for the explanation.

The Program Integrity Unit (PIU) of the SINP was established to safeguard the integrity of
the program and to ensure that applicants are adhering to program criteria, policies and
procedures. This includes ensuring that the information and documents submitted by
applicants are authentic and that misrepresentation has not taken place.

A comprehensive review of your application was conducted and the following
discrepancies have been noted:

Concerns regarding the authenticity and validity of your work experience within
the past ten (10) years prior to your application. In your current application, you provided a work experience letter dated May 10, 2017 from your
employer XX Company. stating your position as an Assistant
Marketing Manager from 2009 to 2013 and was promoted
to Marketing Manager on 2013 under NOC code 0124- Advertising,
marketing and public relations managers.

In contradiction however, information in our database indicates you worked as a IT Analyst (Executive) from
2009 to 2013, as an IT Consultant from 2013 to
2015 under NOC 2171- Information systems and analysts and consultants and as
a IT Project Manager from 2015 to 2017 under NOC 0213-
Computer and information systems managers with your employer XX Company

You provided contradictory information from your employer, supporting different
job titles, Reference letters, NOC code and dates of employment as stated above.
On the above grounds, the PIU has concerns that your work experience details (which
includes your job title, duties, employer, duration of employment and NOC) have been
misrepresented in order to enhance your chances of approval by the SINP and does not
reflect your real work experience.

Note that misrepresentation includes a situation where a person directly or indirectly provides false information or withholds material facts
relating to a relevant matter.

We are prepared to provide you with an opportunity to submit an explanation and any
verifiable evidence that will dismiss our concerns. You must submit the additional
information within ten (10) days by April 22, 2021 via email.

Failure to respond to this letter or provide information to satisfy the PIU may result in your application being
deemed ineligible.

Additionally, if it is determined that misrepresentation has occurred in
your application, you and your family dependents may be suspended from the use of any
SINP programs or services for up to two (2) years.

Should you be unable to provide the information and/or other documents requested, you
must advise us in writing detailing the reasons why you cannot provide the information
and documentation requested. If you fail to comply with this requirement, a decision
concerning your application will be made based on the information we have received in
this application to date, which may result in the refusal of your application.
Misrepresentation is against immigration law in Canada. Information on any
misrepresentation in your application may be shared with the federal government
represented by Immigration, Refugees and Citizenship Canada (IRCC).

As I said, I could not submit the explanation. So, I received below email after 15 to 20 days.

As part of our procedural fairness process, you were emailed on April 12, 2021 advising of
our concerns regarding your work experience in the past ten (10) years prior to your
application. You were provided an opportunity to respond to our concerns by April 22,
2021.

We have not received any response to that email.

You have failed to respond with any information or stronger evidence to overcome our
concerns. As such, we have made a decision based on the information that we had in our
possession, which has led to the conclusion that the alleged misrepresentation in our
Procedural Fairness Letter (PFL) did occur in your application. For this reason, you have
been suspended from using any SINP services for two (2) years. This suspension applies to
any accompanying family members listed in your application and you are not eligible for a
second review.

You can always try applying again. Yes, the provinces and IRCC verify old profiles so you will need to explain the discrepancy.

Ok, so, if I apply for another province, they can find that discrepancy and ask for explanation? What kind of explanation would be good?

Yes, they can find it and ask for an explanation. You will also need to declare that you applied to another province previously and were refused. I don't know what is a good explanation. You misrepresented your work experience in your original CIC profile in order to try to gain an immigration advantage and I'm not sure how you would explain that.
