Hello,
I had posted on this forum previously. I am a university academic professor (senior level)/researcher (dentistry) in India. I became a PR in 2018 and travelled back to India (soft landing) it was my intention to travel and resettle permanently in 2020 when COVID-19 struck. Nevertheless since I had a Ph.D from one of the top universities in Australia and several other universities abroad I applied for several jobs/grants in Canada from India but I was not successful due to a restriction in grant funding in Canada during the COVID period and later and the low level of funding in my area of specialization. However, I tried to make every genuine effort to correspond with people, researchers who could possibly recruit me and I even applied for university positions far below my academic level. I also tried to travel during the period after the second wave of COVID but the flights were booked for months. Later last year I experienced personal issues with an ailing mother who needed my attention and property related issues for which I had to be in India. Further at the age of 47 I don't know if my age and level of seniority played a detrimental role in not landing a job! I know a few of you here would tell me that I never had the intention to settle in Canada in the first place and judge my situation in a different way but this isn't true. I currently have a slight glimmer of hope that one researcher is interested in applying for funding for a grant in Canada along with me however there is no guarantee that this would be successful to see me recruited on a full time position. My PR card expires in Aug 2023 and I am not in compliance with my RO also I do not see many jobs really coming in my research area.
Although I would very much like to renew my PR to get a fresh chance to live and work in Canada I understand this is difficult given my breach of RO. A few of my friends (In other fields) advised me to either reapply for PR again (I do not get enough points now to reapply as I don't get points for age) or look for a temporary work visa if I do get a job. I wish to know the following.
1. Should I try entering Canada with this PR card (if I receive a job opportunity) and later approach a lawyer to retain my PR on H&C or should I consult a lawyer at this stage.
2. If I do enter Canada then I would need a SIN to work but when the card expires in August I don't see how I could go about this or get my card renewed without being in compliance.
3. I would need to travel abroad regularly to visit my mother (staying 2 years inside Canada to be in compliance could prove difficult) and this would not be possible if I don't hold an active PR card.
4. Even if I look at the situation of staying in Canada for 2 years with an expired card wouldn't I be questioned why I did not renew my PR card earlier on expiry?
I would be grateful if someone could suggest the best course of action at this stage without being too judgmental about my situation in the past (as its difficult to relate all my personal circumstances in this post).
Thanks in advance and regards.
