hi Folks,

i am helping my brother in law apply tourist visa for Canada for him and my niece. He is a self employed civil contractor and has agricultural / other properties. Wife/my sister works in IT company. She already has visitor visa.
can you advise what documents should be submitted for business, income and properties for my Brother in law, what can be submitted for my niece?
BIL has never applied for Canada visa, niece has been rejected twice.
I plan to apply for them together.

If niece rejected twice then need to address reasons for refusal. How old is she? Your sister’s TRV may have been approved because niece is staying behind. She can show tuition paid, letter from school.

For your brother in law - business registrations, client receipts/contracts, business taxes, bank accounts. Properties are in his name with any income generated from properties. He can get a property evaluation.

If your brother has any scheduled construction projects for next year or the year after that would also show ties to his home country.
Thanks canuck78, i have asked my brother for contract doc for his construction project. In India, many times people dont show/prepare formal contracts specially in smaller towns. I will ask him to prepare one for his ongoing project.

for brother in law - he is getting the properties evaluated and i will try to get as many on the list as possible.

Challenge is overcoming reason in GCMS notes, visa officer had noted that if my sister and niece were to travel together, sister would have higher pull for Canada. very unfair to make that assumption as if i apply again another officer could make the same conclusion again, I dont how to prove otherwise so need expert guidance there.

I also saw from GCMS notes that my niece and sisters applications were pre-assessed meaning AI determined refusal automatically. I am worried AI might determine same again based on past refusals so this is why thinking to hire a lawyer.
Anycase i dont think i did a good job last 2 times representing my niece plus its lot of stress preparing and compiling everything. I just need to find a reliable lawyer who is trustworthy and wont further mess it up.

Had they ever applied to come to Canada permanently or to work/study? What about other countries? Many lawyers don’t do a good job so wouldn’t trust that they would do a better job than you will.
No, no previous study or PR applications and not to other countries. My sister is approaching 40, is settled in india with her family and has no intentions of immigrating so never tried, challenge is convincing CIC of this. Her visa is anyways done. I somehow have to get my brother in law and nieces application through.

Does your sister live with her in-laws and care for them? That would be good evidence of ties. We have our mother, and 3 siblings /brothers in Canada. Only person remaining in india from my direct family is my sister and her husband, niece and other Extended family on both sides who live in india still. We 3 brothers and mother are the only exception Being in Canada.
From my wife’s side her father is in india , brother/sis in law in USA
My sisters - in laws passed during covid in 2020 both of them so that’s gone.
brother in law does have good amount of parental property at least a million CAD in lands /sites

If it clear that their savings have not come from them and have been supplemented by family in Canada it is viewed differently but yes you can try to help them. All your sister’s close family are in Canada and her in-laws have passed which would be the one family group that would really anchor her family to India so there are valid concerns about them trying to stay in Canada. Would really suggest only applying for your neice first. If approved and brother-in-law denied I would suggest that only the 2 of them travel for a short visit during school holidays or summer break to show a pattern of following the immigration rules.

Wouldn’t be strange for just your neice and sister to want to travel to Canada. It is your family in Canada and it is very expensive to travel. Wouldn’t be strange for just your neice and sister to want to travel to Canada. It is your family in Canada and it is very expensive to travel. Perfectly reasonable to say that your sister and neice would like to come for a visit her family members while her husband stays at home and continues working.
