Inland app, entering as visitor and applying for OWP

Hi,

- I (the PA) will enter as visitor (I am from a visa free country) and I will apply for inland spousal sponsorship within 1 month from entering
- At the moment, it looks like inland app are getting faster, so I expect I can apply for the OWP within 3 months from entering
- here is the question: after 5 months of being in Canada, do I need to apply for extended visitor visa to stay another 6 months? or since I have applied for the OWP I have got maintained status until I receive the OWP?
- once I receive the OWP, does that gives me right to temporary reside in Canada?
- will the OWP have an expiry date? My husband is Canadian and I will have a passport that will be valid for 9 years

Where are you seeing that Inland applications are processing faster than Outland? Are you aware that if you successfully enter Canada as a visitor, you can submit an Outland application from within Canada? You wouldn't be eligible for the OWP, but the overall PR process could be in fact faster.

Submitting an OWP [Inland] while having legal visitor status will give you Maintained Status.

The OWP will have an expiry date but in any event it will be void the minute you become a PR.

I see here that inland is faster with AORs being received within 10 days for those who submitted in Oct 22. And OWPs have been given in less than 60 days in July and Aug 22. Also I will apply in July 23 when most backlogs should be cleared. Plus IRCC introduced a semi-automated system for inland apps.

Someone suggested me to still apply for visitor record as well as OWP, just in case OWP is returned, so that I can keep maintained status. Do you agree with this idea?

Why would you expect the OWP to be returned? If you have received AOR, fill out the OWP accurately and completely, making sure to pay the full fee. Seems like a waste of $ to also apply for a visitor record, in tandem, but...it might make you feel better.

Just read a story on another forum about someone who got the OWP rejected.

If I was to get the OWP rejected too, would I have a few grace days to submit the visitor recond application? or would I have no other option than leave the country?

If you have AOR for OWP than you don’t have to extend visitor status. If you want to be cautious until you receive AOR for OWP it is a good idea to extend your visitor status but not required. Now that things have moved online likely less chance of having OWP returned.

Thanks, if I was to get the OWP rejected and did apply for visitor record in the meantime (and I have been in the country more than 6 months), would I have grace period/a few days to submit the visitor recond application? or would I have no other option than leave the country?


Also, independently from the OWP. If I enter as visitor, then apply inland for spousal sponsorship, once I get AOR for spousal sponsorship, would not that be sufficient to be on maintained status until I get the PR decision?

No. The AOR does not give you Maintained Status. The OWP submitted after AOR does, as long as you have legal status on the day that you submitted the OWP application.

You're driving yourself crazy asking the same question ad nauseam. Plan to apply to extend your visitor record a couple of days before it expires; it's the only way you're going to lower your stress level...even though the OWP [alone] would be sufficient.
