3rd year UBC student returned home, visa refused.

I need two more semesters to graduate from UBC.
I went back to China and planed to return to Canada before September. My visa is expired, so I applied for a new one.

Here is the refusal reason given on the letter:
"I am not satisfied that you will leave Canada at the end of your stay as required by paragraph 179(b) of the IRPR. I am refusing your application because you have not established that you will leave Canada, based on the following factors:
• The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application."


I don't understand why I was not allowed to finish my study in Canada. How am I going to prove that I will leave Canada after graduation? My purpose to visit Canada is always the same - to study.
Anyone knows how to deal with this? I need to reapply as soon as possible because I will miss classes in fall semester.

That's a confusing refusal reason.

What did you submit with the TRV application? Did you show a valid study permit / proof of enrolment?

Yes, I submitted my study permit, but it's expired during my visa application processing period. I have also uploaded a letter from UBC science department stating when I began my study there and when I'm going to graduate. I was not enrolled for next term at the time when I submitted my application, but now I'm enrolled for September.

I have also uploaded a letter from UBC science department stating when I began my study there and when I'm going to graduate. I was not enrolled for next term at the time when I submitted my application, but now I'm enrolled for September.

I thought study permit is only obtainable when I return to Canada at custom?
I need a visa to return first?

My visa expired, but my study permit was still valid at that time. I applied for a new visa when I'm out of Canada. My study permit expired while I'm waiting for my visa result. They are both expired now.

Did you indicate that you were applying for a TRV to continue your studies and provide proof that you had been attending UBC full-time for 3 years? At this point you need to be applying for a new study permit not a TRV.

I am in the same situation as yours - a McGill student with expired TRV and yet-to-be expire SP. I have applied for SP to renew both my status and visa. It sounds like you have done the right thing and attached the right documentation, as I have done the same. Besides that, I have also attached a letter from my thesis supervisor to support my application.

Will ordering GCMS notes help you, but I am concerned about whether it will delay your application further? You can also seek immigration help from UBC (I'm not sure such a thing exists in your univ, but we have a solid system, and they used to offer the best advice). Also, how many days did they take to review your application?

When I started my application on IRCC after filling out all the questionnaires, the system directed me to a TRV automatically. I was not given a chance to choose study permit. I think it is because my study permit has not expired at that time.
Today, I tried to re-apply again and this time I got directed to a study permit application since I chose "NO" for the study permit question in the questionnaires.

I forgot to ask that for study permit, IRCC asks me to upload an acceptance letter, not enrollment letter this time. The two letter are different, aren't they? Should I get both of them? After getting the study permit, do I need a visa to come to Canada?

Might as well include both but usually people are applying who haven’t started their program thus the LOA requirement. Would include transcripts indicating that you’ve been studying.

How can you apply both at the same time?
Well, I had a month before the expiry of my study permit, so I applied for a visitor visa. As you mentioned earlier, the questionnaire didn't show me the SP option. However, I would have applied for the SP, if I had my CAQ then. Anyway, when you apply for SP outside the canada, they will technically issue an TRV for you. So at this point of time, you can just reapply for SP with strong documents.
Besides, my SP was approved yesterday.
