Confused about Residency obligation calculation as of June 5th 2022

Hi,

I became PR on 10th Aug 2018 (Landing Date). As of today i.e. 5th June 2022, I have been present in Canada for a total of 325 days.

Considering this, I still need to be in Canada for another 405 days out of the available 431 days till my first 5-year anniversary since becoming PR.

Firstly, Is my calculation correct?

I am working in the Canadian entity of a US organization and they are asking me to occasionally travel to the US on a business visa for meetings and client conversations. I have been able to avoid travel till now due to the non-availability of appointments for US business visa travel.

Considering the job situation and the less number of buffer days available, I am planning to tell my employer that I cannot travel to the US in any case. In this case, it might not be possible for them to continue to employ me and I will have to find another job in Canada. I cannot avoid traveling to India in case of any family emergency so want to keep the buffer days safe.

Please guide me, on how should I approach this situation.

You are correct that you need to have 730 days in Canada within each 5 rolling year period to meet the PR residency requirement. So you are correct that if you only have 325 now, you need another 405 within the five year period. Most of us here aren't really comfortable doing the calculation for someone else in case we make an error. It's really up to you to validate your own numbers.

If it is a priority to be able to visit your home country in the event of an emergency, then it makes sense to tell your employer that you cannot make business trips to the US.

If you are working for a Canadian Entity of a US Organization best way is to tell them about your situation. the 730 days is a MUST for your to fulfill your residency obligations no question about it and no going around it as well.

Don't assume what will or will not be your company action/decision regarding your situation. Piece of advice. Don't count the exact 730 days only as many cases few days here and there that you forgot to account for will be giving you a big problem in the end

@danilorniepes @scylla Thanks for your responses. For the moment, the issue appears to be solved. I had spoken with my US employer and told them I will not be able to travel to the US for business purposes since I need to meet residency obligations in Canada. One thing which I have in my control is US business visa application. Though they seem to understand my situation, if they force me to come, I plan to abandon my US Business Visa application. As of now, the appointment is scheduled for October 2022.
