So where did you send your application first?

You said you sent it to Ottawa first, but it should be New Delhi.

Even so, it actually should be the CIO in Sydney, NS, if you were in Canada, but not Ottawa.

But if you got the GCMS and it shows progress, I suppose you did what is right for your case.

It may delay, but I dont know, to be honest. It is an extra risk. Recently, people have been denied entry in the US, and we are talking about visiting. Even parking tickets will be checked. A person who obtained pot, in most countries, obtained it from obscure sources. People related to obscure activities may have sought recreation, and may be super nice people, but the fact is that the databases don't know you and how nice you are.

Most won't admit it, but there 4 types of people:
1 - Those who will never do anything bad,
2 - those who could perhaps do something bad
3 - those who may have made small mistakes in the past and/or are prone to make mistakes
4 - criminals

They will check if you are a good guy. Drug is a factor, isn't it? Processing time is super fast for 1 and 4: Passed and denied right away. For 2 and 3, those checks are longer. It may use a computer and take seconds. Or it may need a login and checks of who you bought stuff from. If the source is someone not dangerous, it may take minutes, but if your source is a crime kingpin you met frequently in a shady nightclub, it may take longer because they don't know your involvement with that person, and they have to check, so there are varied degrees of where pot led to.

Being denied a PR is something different than lengthening the process. For that line, it was said that an application may take longer, not that it will, because, honestly, I don't know. We are trying to look at all the factors that affect time (not rejection), and they have different weights.

I may be wrong, but I believe pot, for creating contact with criminals, may weigh in, because (this I know for sure) even the genuine marriage of a guy who comes to Canada and one year later marries the girlfriend he left in his country takes longer because they ask for proof of the previous relationship.

Pot may be ignored by CIC, but not by CSIS, they will try to know your hidden wrongdoings, not the clear ones. If someone shows up in the database with more lines, it takes time. If it is just pot, then meh, 30 minutes later they send the results saying "nothing more than pot, porn, lots of google search about UFOs, too many hours in COD, cat videos and a speeding ticket was found."
You become mad !!

Hi. Maybe you could request a new WP support letter from the province. I didn't use mine in the 6 months, so it expired. I requested a new one, and it came in 7 days (ON). I was surprised by how fast it came.

Otherwise, if it is your case, you can apply for PGWP and get it for a period = to your studies.
my PGWP is expiring in a few days. I applied for bridge. Not sure what you are referring to. And the WP support letter you were saying, does ON have it and how to get it?

Hi.
You are a provincial nominee right?
On your nomination package there is a work permit support letter for 2 yours. This WP support letter is there make you "last" in Canada until your PR is issued, but it does not account for exceptions.

If you never used that letter, it expired but you can get a new one. Call or email them, ask for a new one explaining that your PR is not issued yet. They will judge and give you an answer. I did this by phone and the wait was short, like 5-10 minutes.

If your nomination is for a work based stream, like international student with job offer or foreign worker with a job offer (or whatever they call it in the province you live) you will have to be employed with the same employer, and to get the WP, they will have to make the job offer in the employer portal, and you will be locked with that employer until you get the PR. There is a bit of a headache, but the employer portal is super simple, all one need is to contact PR and pay the fee.

Hi Thanks Tommy,
I am with the master stream without job offer, and believe me I don't even know about this. I assume that I can just cntact OINP and they can give me that? Sounds convenient comparing to a bridge work permit.

Since you are not in a work based stream, I don't know if you can do it. But it is worth trying. Give them a call.

In your case case, I think you will bridge to a OWP without any issue because the bridging was created exactly for people like you. It exists to lengthen a OWP untill you get the PR.

People in Job offer based streams, on the other hand, cannot bridge their permits.

Hi.
Just playing the devil's advocate here and trying to find issues on your profile. It seems like the problem may be in the relationship. But I'll ask about all possibilities.

1)So you have been in Canada for 8 years now and you are still not a PR. Why? Usually one would get enough English and points to get the PR through EE, or at least a nomination.

2)If you have been in Canada for 8 years, where have your spouse been during this time? Is he/she here now?

3)Having prior refusal IS a possible cause for the delay. If you had a real relationship before the refusal and he/she wanted to visit you, that is very uncommon, as even OWPs are issued because they cannot separate families. If so, it must be a very strong reason. But if he/she later got a visa, then it should be alright as the prior refusals won't matter much.

4)If you didn't declare to be married when coming for the first time to Canada, that could be an issue. If you stayed 8 years apart, and now want to reunite, that could be seen as marriage for convenience bc 8 years apart is too much. Or... if you were not married, but in a relationship, and you came for whatever reason, while later your spouse tried to come but got refused, and then you applied as a couple, that could be seen as a marriage for convenience as well. They will investigate to see if the spouse is trying to piggyback on you, because he/she could not get a visa by other means. But if you are definitely eligible, the marriage is real and you can prove it (Facebook or family photos older than 8 years), the spouse will get approved with you. It is possible to stay 8 years apart, and if you were in a distant relationship, you can still back your claim with communications (email, phone logs, letters with stamps), trips and photos from visits, and so on and it could work.

I'm not assuming the marriage is not real, I am just trying to cover all options. A year or two ago, they refused a couple for being just 2 years apart and because the woman was much older than the man, and the refusal said that this is not common in the culture in question. CIC was accused of racism and the couple is suing. CIC answered saying they did not provide the additional docs in time to satisfy that they were in a relationship. I never saw the resolution for that case.

Because marriage for convenience became a business for some people, CIC is going hard on these people. If you read along some threads here, you will probably notice one or two once in a while.

And finally, Ukraine is a country with good diplomatic relations with Canada. No issues there.
Thanks for your response, Tommy. Yes, they probably suspect that our marriage is not genuine. When we applied for our previous SOWP in 2016, we showed photos of us together going back to 2005. We provided letters of support from family and friends. That was our immigration consultant's advise. It was obvious that our relationship is 100% genuine. We were married at that point. That did not convince the CIC.
Why have I been here for 8 years on a temporary status? When I started applying for PR, it was 6 years. Before that I was a student and was waiting for a work permit. I didn't qualify for PR. It is that simple.
Finally, Ukrainian are being refused visitor visas, study and work permits at a tremendous rate. We have good diplomatic relationship with Canada only on a superficial level. In reality, Canada government thinks we are all potential illegal immigrants. If you know any Ukrainian, ask them about their visa refusal stories. You will hear many. Almost every Ukrainian I know here had trouble bringing in their family and friends to visit. Some have never been successful, like me.

That seems like a very complicated case. Maybe you could sue if you think they are withholding your application without a valid reason. Especially because you have a relationship going back all the way to 2005.

That is a complicated case.
1)Did you overstay that permit? Did you have a visitor status or you left Canada immediately?
2)Are you still in Canada since then?
3) Did you get an AINP job-offer based nomination that locks you to an employer?

Regardless of the answers, you gotta do what you are told to in the permits, otherwise you risk losing everything. It is not worth it.

You may request a GCMS note if you are in Canada or request with a representative. Maybe you should try updating CIC with everything that changed (addressee, job, permits), and writing a letter of explanation about the medical case with evidence. I really can't help much. In your case, an immigration consultant or lawyer could be useful to at least tell you what should be your next step.

Not mandatory.
The only issue would be overstaying the permit, because as soon as the first expired you must leave or ask to restore your status. Because you do not have implied status until they process the new one request as you missed the ddeadline, you cannot work.
You should have asked to restore your status before the WP. So it got denied. After that denial, you should ask only for a restoration of visitor status, not a new WP, as it will be denied again. Then, after restoration, you can apply for a WP. Ideally, the best course of action is leave and apply to restore the status at the Port of entry (or as a new visitor instead of restoring, but I'm not sure if it can be done) and I see no issues with that since you have a PR application in progress for 22 months.
As you seek to restore your visitor status to then get a new WP, make sure you do not work, as you would be in disacordance with your visitor status and it could ruin your PR application.

Read this about restoration:
https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/visitors/restoration-status.html

And this that applies to your case:

Extending a visit after a work or study permit refusal
If a visitor in Canada applies for and is refused a work or study permit, their visitor status is not affected. Upon receiving notice of the work permit or study permit refusal, the visitor must submit a separate application to extend their temporary resident status as a visitor before the expiry date of their temporary resident status, if they wish to remain in Canada.

If their status at the time of the work permit or study permit refusal was valid due to the application of subsection R183(6) (i.e., it was "implied status"), then they will have to apply for a restoration of visitor status if they do not wish to leave Canada.

https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/visitors/inland-applications-permanent-residence-status-extension.html
