WP refusal after an interview with CIC have been asked to leave the country

Hi guys,

my friend has applied for a WP last August 2011 after 2 months she received a letter that it would take longer, so she waited then 3 months ago CIC have told her to expect an interview in Edmonton. Last June she went for the interview after couple weeks she got a letter of refusal of WP and has been asked to leave the country.

Is there anything that can be done??? any input would be really appreciated!

if that is last year the wait and processing is too long for a wp already in canada. it's like already a whole process of applying for an LMO with advertising then recruiting outside canada following all the works to be done further.

what is remarkable is after refusal of wp comes advisory to leave canada. the verdict is there - "leave canada".

at the moment regardless of what situation your friend has. your friend will be back to square one of applying a work outside canada.

this is just my own analysis/opinion and no intention to make anyone down here.

if your friend is willing to shed some hundreds for a professional advice, ideally seek an immigration lawyer vs. immigration consultant. or if has option to go a neighboring country like u.s then that's her nearest base to start things all over again...

i hope your friend can find a better option...

she has been also told to go to states and apply for WP, but what is guarantee that she gets it approved...so we are trying to find an alternative.

Tell your freind to go get apply in Montana for a work permit. That day she''ll get a response. and by the way what's the reason she get denied??? and make sure that the employer back her up...Thats the key ask for a letter from a Canadian employer...ok. Goodluck to your freind..

What is the status of your friend when she applied for the WP? What country is your friend from? What type of job did your friend apply for? Did she have a positive LMO?

i don't really know the reason of refusal as she is very depressed now and cant really communicate but as far as I know she came to study in vancouver for a year and she didn't like college as they were not teaching anything. She said it was awful. She felt bad for loosing so much money (that was borrowed from family and friends) for nothing. So she went to a "lawyer" to find out her options. He told her that he would help her to apply for a work permit. But the problem I guess was that she dropped college and started working that's how everything started. Sorry i dont know what was exactly written in a refusal letter...

So she started working without the work permit. If that is it, game over. If she doesn't leave, she will be reported and a removal order will be issued. If she worked without authorization she can't apply for a work permit until 6 months after departing Canada.

you mean to say pmm that the cic identified already if someone is working without proper work permit and that's the reason why asked to go ang leave canada?

She had a work permit with her first employer after college...its' very strange situation. From what I understood that maybe CIC gave her refusal is because while having a valid study permit she got a work permit?

We need more information to answer these questions. What kind of work permit did she have? Did she have an off campus work permit that was given to her because she was here as a full time student? If so, then this type of work permit limits the number of hours you can work per week (you can't work full time) and you can only continue using this work permit as long as you stay in school full time. If she dropped out of college - then she should have stopped working using the off campus work permit. This is another possible reason why CIC might have refused her work permit application (for working illegally previously).

Again, very difficult to answer you questions without much more detailed information.
